Common use of Overtime Definitions and Rates of Pay Clause in Contracts

Overtime Definitions and Rates of Pay. When operating requirements or other needs cannot be met during regular working hours, employees may be scheduled to work overtime hours. The Court shall use reasonable efforts to assign overtime on an equitable basis. All employees who work more than forty (40) hours in one workweek, will receive overtime pay computed at the rate of one and one-half (11/2) times the employee's regular rate of pay for all hours worked in excess of forty (40) hours in any one workweek. Only those hours that are actually worked and holiday hours are added together to determine an employee's pay. Paid time off for vacation, sick leave, bereavement leave, time off to vote, or for any other leave of absence, will not be counted as hours worked for the purposes of determining overtime for employees.
