Owners’ Reservation of Rights. Except as otherwise expressly provided herein, the Owners reserve to themselves, and to their successors and assigns, all rights accruing from their ownership of the Mohave Site Property, including without limitation their legal rights to subdivide the Mohave Site Property for any purposes allowed by law, and the right to sell, transfer, lease, license or otherwise encumber any or all ofthe Mohave Site Property.

Owners’ Reservation of Rights. Owner expressly reserves all rights, claims and causes of action that it may have against Principal and/or Surety under the Contract, this Agreement and/or the Bonds to seek recovery of any and all damages incurred by Owner as a result of defaults under and/or breaches of the Contract, this Agreement and/or the Bonds. The rights, claims and causes of action reserved by Owner shall include, without limitation, claims for all damages incurred by Owner as a result of Principal's and/or Surety's defaults. Notwithstanding any language in the Contract to the contrary, the making of payments to Surety as provided for herein shall not constitute a waiver of any rights or claims for damages resulting from breaches of the Contract. By paying the Takeover Agreement Balance to Surety, Owner is merely (i) acknowledging completion of the construction work as required by the Contract (to the extent of the payments) and (ii) allowing Surety to act as the stakeholder of disputed amounts under the Contract. Surety hereby acknowledges that BCC has reserved its rights with respect to damages incurred as a result of defaults of Principal and that BCC has the right to and may assert claims against Surety and/or Principal to recover all such damages.
Owners’ Reservation of Rights to Portions of the ------------------------------------------------ Building: All parts (except surfaces facing the interior of the Demised -------- Premises) of all walls, windows and doors bounding the Demised Premises (including exterior Building walls, core corridor walls, doors and entrances), all balconies, terraces and roofs adjacent to the Demised Premises, all space in or adjacent to the Demised Premises used for shafts, stacks, stairways, chutes, pipes, conduits, ducts, fan rooms, heating, air conditioning, ventilating, plumbing, electrical, telecommunication and other mechanical facilities, closets, service closets and other Building facilities, and the use thereof, as well as access thereto through the Demised Premises for the purposes of operation, maintenance, alteration and repair, are hereby reserved to Owner subject to any specific provision of this Lease. Owner also reserves the right at any time to change the arrangement or location of entrances, passageways, doors, doorways, corridors, elevators, stairs, toilets and other public parts of the Building, provided any such change does not permanently and unreasonably obstruct Tenant's access to the Demised Premises. Nothing contained in this Article shall impose any obligation upon Owner with respect to the operation, maintenance, alteration or repair of the Demised Premises or the Building. In the event that such access must be granted by Owner, Owner shall give prompt notice of such grant of access to the persons listed on Tenant's emergency contact list annexed as Exhibit 7 to this Lease. Notwithstanding anything to the contrary contained in this Section 13.02, Owner agrees to maintain the existing 00/xx/ Xxxxxx and 52/nd/ Street entrances to the Building during the Demised Term, subject to the provisions of this Lease.
Owners’ Reservation of Rights. Owner reserves the right to rescind, alter or waive any rule or regulation at any time prescribed for the Building when, in its judgment, it deems it necessary, desirable or proper for its best interest and for the best interests of Tenants, and no alteration or waiver of any rule or regulation in favor of one Tenant shall operate as an alteration or waiver in favor of any other Tenant. Owner shall not be responsible to any Tenant for the non-observance or violation by any other Tenant or any of the rules or regulations at any time prescribed for the Building.
Owners’ Reservation of Rights. Where Contractor’s services have been so terminated by Owner, the termination will not affect any rights or remedies of Owner against Contractor then existing or which may thereafter accrue. Any retention or payment of moneys due Contractor by Owner will not release Contractor from liability.

Upon the termination of the Forbearance Period, the agreement of the Investor to forbear and the other agreements of the Investor, in each case as set forth in Section 2 above, shall automatically and without further action terminate and be of no force and effect, it being understood and agreed that the effect of such termination will be to permit the Investor and the Collateral Agent (acting upon the instructions of the Investor and on behalf of the Investor) to exercise any and all of its rights and remedies at any time and from time to time thereafter, including, without limitation, the right to accelerate all or any portion of the obligations under the WorldSpace Notes and exercise any other rights and remedies set forth in the WorldSpace Notes, the other New Transaction Documents, applicable law or otherwise, in each case, without any notice, passage of time or forbearance of any kind. The Investor reserve the right to request any additional information (financial or otherwise) with respect to the Specified Defaults or any other Event of Default or otherwise.

  • Preservation of Rights No delay or omission of the Lenders or the Administrative Agent to exercise any right under the Loan Documents shall impair such right or be construed to be a waiver of any Default or an acquiescence therein, and the making of a Loan notwithstanding the existence of a Default or the inability of the Borrower to satisfy the conditions precedent to such Loan shall not constitute any waiver or acquiescence.
