Patent Term Restoration/Supplemental Protection. The Parties shall cooperate with each other in obtaining patent term restoration, extensions or supplemental protection certificates or their equivalents in any country in the Enzon Territory where applicable to LNA Compound Patents. If elections with respect to obtaining such patent term restoration, extensions or supplemental protection certificates are to be made, Enzon shall have the right to make the election and Santaris agrees to abide by such election.

Patent Term Restoration/Supplemental Protection. The Parties shall cooperate with each other in obtaining patent term restoration or extensions (including supplemental protection certificates or their equivalents in any country). If elections with respect to obtaining such patent term restoration or extensions are to be made, the Owning Party shall have the right to make the election after consulting in good faith with the JPT.

  • General Application The rules set forth below in this Article VI shall apply for the purpose of determining each Member’s allocable share of the items of income, gain, loss and expense of the Company comprising Net Income or Net Loss of the Company for each Fiscal Year, determining special allocations of other items of income, gain, loss and expense, and adjusting the balance of each Member’s Capital Account to reflect the aforementioned general and special allocations.
