Payment of Attorneys’ Fees and Service Awards. Within (15) fifteen business days after the Effective Date, or another time frame as may be ordered by the Court, the Claims Administrator shall issue from the Settlement Fund payment for the Court-approved attorneys’ fees and litigation expenses. The Claims Administrator shall wire the funds for attorneys’ fees and litigation expenses to Xxxxxxxx Xxxxxxxxx, PLLC IOLTA. The Claims Administrator shall include any Court-approved Service Awards with the Settlement Sums due to the Plaintiffs (if any) according to the Settlement Distribution Timeline discussed below.
Payment of Attorneys’ Fees and Service Awards. 1. Subject to the terms and conditions of this Settlement Agreement, within ten (10) days of Effective Date, Defendants shall pay an amount equal to the amount the Court awards for Attorneys’ Fees and Costs and for Service Awards into the Qualified Settlement Fund.
Payment of Attorneys’ Fees and Service Awards. 80. Defendants agree not to oppose Class Counsel’s request for Class Counsel Fees of up to 22% of the $8,669,083.00 Settlement Fund, or $1,907,198.26. Any award of attorneys’ fees to Class Counsel shall be payable separate and apart from the Settlement Fund available to Settlement Class Members, thereby ensuring that the Settlement Class Members receive 100% of their claimed losses. The Parties agree that the Court’s failure to approve, in whole or in part, any award for attorneys’ fees shall not prevent the Settlement Agreement from becoming Effective, nor shall it be grounds for termination.
