Payment of Civil Penalty to the United States. Within Ninety (90) days of the Effective Date of this Agreement, the CMC III will commence payment of $50,000.00 to the United States of America. Payment of Civil Penalty to the United States. Within thirty (30) days of the Effective Date of this Agreement, Kent Hospital will pay the United States FIVE THOUSAND DOLLARS $5,000 pursuant to 42 U.S.C. § 12188(b)(2)(C) to vindicate the public interest for the alleged violations of Title III of the ADA contained herein. Full payment will be made by electronic funds transfer pursuant to instructions to be provided by the United States Attorney’s Office for the District of Rhode Island.
Payment of Civil Penalty to the United States. Within fifteen (15) days of the Effective Date of this Agreement, FRMC will pay civil penalty to the United States in the amount of $62,500, pursuant to 42 U.S.C. § 12188(b)(2)(C), via wire transfer or online using written instructions provided by the United States. FRMC shall provide written notification of counsel for the United States within seven (7) days of completing the actions described in this Paragraph.

  • California Judicial Reference If any action or proceeding is filed in a court of the State of California by or against any party hereto in connection with any of the transactions contemplated by this Agreement or any other Loan Document, (a) the court shall, and is hereby directed to, make a general reference pursuant to California Code of Civil Procedure Section 638 to a referee (who shall be a single active or retired judge) to hear and determine all of the issues in such action or proceeding (whether of fact or of law) and to report a statement of decision, provided that at the option of any party to such proceeding, any such issues pertaining to a “provisional remedy” as defined in California Code of Civil Procedure Section 1281.8 shall be heard and determined by the court, and (b) without limiting the generality of Section 10.04, the Borrower shall be solely responsible to pay all fees and expenses of any referee appointed in such action or proceeding.
