Administrative Civil Liability. The Discharger hereby agrees to the imposition of an administrative civil liability of $816,000 to resolve the alleged violation set forth in Section II as follows:
a. The Discharger is credited $29,000 for its payment of stipulated penalties pursuant to Consent Decree section XX.B.
b. No later than 30 days after the Regional Water Board or its delegate signs this Stipulated Order, the Discharger shall mail a check for $379,000, made payable to “State Water Pollution Cleanup and Abatement Account,” referencing the Order number on page one of this Stipulated Order, to: State Water Resources Control Board Accounting Office Attn: ACL Payment P.O. Box 1888 Sacramento, CA 95812-1888 The Discharger shall email a copy of the check to the State Water Board, Office of Enforcement (xxxx.xxxxxxxxxx@xxxxxxxxxxx.xx.xxx), and to the Regional Water Board (xxxxxxx.xxxx@xxxxxxxxxxx.xx.xxx).
c. The Parties agree that the remaining $408,000 of the administrative liability shall be paid to the Regional Monitoring Program, care of the San Francisco Estuary Institute (SFEI), for implementation of a Supplemental Environmental Project (SEP) named “San Francisco Bay Sediment Transport and Fate Modeling,” as follows:
i. $408,000 (SEP Amount) shall be paid in the manner described in Section III, paragraph 1.c.ii, solely for use toward the SEP Fund for the “San Francisco Bay Sediment Transport and Fate Modeling” project. Funding this project will produce a foundational quantitative model of sediment transport and fate in San Francisco Bay that can be used to address management questions for polychlorinated biphenyls (PCBs), nutrients, and sediment. A description of this project is provided in Attachment B, which is incorporated herein by reference.
ii. No later than 30 days after the Regional Water Board or its delegate signs this Stipulated Order, the Discharger shall mail a check for Regional Monitoring Program c/o San Francisco Estuary Institute 0000 Xxxxxxx Xxxxxx Richmond, CA 94804 The Discharger shall email a copy of the check to the State Water Board, Office of Enforcement (xxxx.xxxxxxxxxx@xxxxxxxxxxx.xx.xxx), and to the Regional Water Board (xxxxxxx.xxxx@xxxxxxxxxxx.xx.xxx).
Administrative Civil Liability. The Discharger hereby agrees to the imposition of an administrative civil liability totaling $120,100 to resolve the alleged violations as set forth in Section II, paragraphs 4 and 5, as follows:
a. No later than 30 days after the Regional Water Board or its delegate signs this Stipulated Order, the Discharger shall submit a check for $60,050 made payable to the “State Water Pollution Cleanup and Abatement Account,” with reference to the Order number on page one of this Stipulated Order, to the following address: State Water Resources Control Board Accounting Office Attn: ACL Payment P.O. Box 1888 Sacramento, CA 95812-1888 The Discharger shall provide a copy of the check via email to the State Water Resources Control Board, Office of Enforcement (xxxxxxxxx.xxxx@xxxxxxxxxxx.xx.xxx) and the Regional Water Board (xxxxxxx.xxxx@xxxxxxxxxxx.xx.xxx).
b. The Parties agree that $60,050 of the administrative civil liability amount shall be suspended pending completion of the ECA described in Section III, paragraph 2, and Attachment B, incorporated by reference herein.
Administrative Civil Liability. The Settling Respondent hereby agrees to the imposition of an administrative civil liability totaling $635,000 to resolve the alleged violations as set forth in Section II.
Administrative Civil Liability a. The Discharger hereby agrees to the imposition of an ACL in the amount of seventy-five thousand dollars ($75,000) to the Central Valley Water Board to resolve the violations specifically alleged in Attachment A to this Order.
b. In lieu of assessing all the seventy-five thousand dollars ($75,000), the Parties agree that the Discharger shall spend an equivalent amount towards the completion of a Compliance Project and the ACL shall be suspended (Suspended Liability) if the Discharger complies with the time schedule and requirements for the Compliance Project as detailed herein and in Attachment B of this Order. Attachment B to this Order is attached hereto and incorporated herein by this reference.
Administrative Civil Liability. A) The Discharger herby agrees to the imposition of an ACL in the amount of twenty-four thousand dollars ($24,000) to the Central Valley Water Board to resolve the violation specifically alleged in Attachment A to this Order.
B) The entire twenty-four thousand dollars ($24,000) penalty will be suspended through the completion of the Compliance Project described in Finding 13, in accordance with Water Code section 13385(k) incorporated herein by reference. This amount is also referred to as the Suspended Liability Amount.
Administrative Civil Liability. The Settling Respondent xxxxxx agrees to the imposition of an administrative civil liability totaling $465,500 to resolve the alleged violations as follows:
a. To resolve the alleged discretionary violations as described in Section II, paragraph 20 and Attachment A, no later than 30 days after the Regional Water Board, or its delegate, signs this Stipulated Order, the Settling Respondent shall submit a check for $141,250 made payable to the “Waste Discharge Permit Fund,” reference the Order number on page one of this Stipulated Order, and mailed to: State Water Resources Control Board Accounting Office Attn: ACL Payment P.O. Box 1888 Sacramento, CA 95812-1888 The Settling Respondent shall provide a copy of the check via e-mail to the State Water Resources Control Board, Office of Enforcement (Xxxxx.Xxxxxx@xxxxxxxxxxx.xx.xxx) and the Regional Water Board (Xxxxx.Xxxxx@xxxxxxxxxxx.xx.xxx).
b. To resolve the alleged MMPs as described in Section II, paragraph 21 and Attachment B, no later than 30 days after the Regional Water Board, or its delegate, signs this Stipulated Order, the Settling Respondent shall submit a check for $84,000 made payable to the “State Water Pollution Cleanup and Abatement Account,” reference the Order number on page one of this Stipulated Order, and mailed to: State Water Resources Control Board Accounting Office Attn: ACL Payment P.O. Box 1888 Sacramento, CA 95812-1888 The Settling Respondent shall provide a copy of the check via e-mail to the Office of Enforcement and the Regional Water Board at the e-mail addresses set forth above.
c. The Settling Respondent agrees that $240,250, consisting of half of the discretionary penalty amount ($141,250) and $84,000 related to the MMPs per Water Code section 13385, subdivision (l) (i.e., $15,000 + ($183,000- $15,000)/2 = $84,000), of the administrative liability amount shall be paid to the Regional Monitoring Program care of the San Francisco Estuary Institute for implementation of a Supplemental Environmental Project (SEP) as follows:
i. $240,250 (SEP Amount) shall be paid solely for use towards the Supplemental Environmental Project (SEP) Fund for the San Francisco Bay Regional Monitoring Program. Funding this project will include a study related to hydrodynamic and water quality model calibration and application in San Francisco Bay and Lower South Bay. A complete description of this project is provided in Attachment C, incorporated herein by reference.

Administrative Civil Liability. A) The Discharger agrees to the imposition of an ACL in the amount of one hundred and eighty-three thousand dollars ($183,000) to resolve the violations alleged in Attachment A.
B) The Parties agree that the entire ACL amount of one hundred and eighty-three thousand dollars ($183,000) will be suspended pending completion of the Compliance Project described herein and Attachment B. This amount is also referred to as the Suspended Liability Amount.
Administrative Civil Liability. UC Farms hereby agrees to the imposition of forty-two thousand three hundred and forty-eight dollars ($42,348) in administrative civil liability to resolve the violation set forth in Section II, paragraph 6. UC Farms must submit payment by check or other authorized method of payment5 in the amount of forty-two thousand three hundred and forty-eight dollars ($42,348) no later than 30 days following the date the Central Coast Water Board or its delegate signs this Stipulated Order. b. The Parties agree that the remaining $60,000 of the administrative liability shall be paid to the Regional Monitoring Program, care of the San Francisco Estuary Institute (SFEI), for implementation of a Supplemental Environmental Project (SEP) named “Temporal Variability in Sediment Delivery to a San Francisco Bay Salt Xxxxx,” as follows:
i) $60,000 (SEP Amount) shall be paid in the manner described in Section III, paragraph 1.b.ii, solely for use toward the SEP Fund for the “Temporal Variability in Sediment Delivery to a San Francisco Bay Salt Xxxxx” project, as set forth in Attachment B, which is incorporated herein by reference. Funding this project will enable the investigation of the influence of tides, waves, and water levels on sediment delivery and deposition on a tidal xxxxx surface in San Francisco Bay. A full description of this project is provided in Attachment B.
ii) No later than 30 days after the Regional Water Board or its delegate signs this Stipulated Order, the Discharger shall mail a check for $60,000, made payable to “Regional Monitoring Program” and referencing the Order number on page one of this Stipulated Order, to: Regional Monitoring Program c/o San Francisco Estuary Institute P.O. Box 632 0000 Xxxx Xxxxxx Xxxxxx, XX 00000 The Discharger shall email a copy of the check to the State Water Board, Office of Enforcement (xxxx.xxxxxxxxxx@xxxxxxxxxxx.xx.xxx), and the Regional Water Board (xxxxx.xxxxx@xxxxxxxxxxx.xx.xxx).
Administrative Civil Liability. The Dischargers hereby agree to the imposition of an administrative civil liability in the amount of $79,690 (seventy nine thousand six hundred ninety dollars) to resolve the violations specifically alleged in this Stipulated Order as follows:
a. No later than 30 days after the Effective Date of this Order, the Dischargers shall submit a check for $4,690 (four thousand, six hundred ninety dollars) to the State Water Board. The check shall be made payable to the “State Water Pollution Cleanup and Abatement Account,” shall reference Order No. R6T- 2024-0004, and shall be mailed to: State Water Resources Control Board Accounting Office Attn: ACL Payment P.O. Box 1888 Sacramento, CA 95812-1888 The Dischargers shall provide a copy of the check via email to the State Water Board, Office of Enforcement (Xxxxxx.Xxxxx@xxxxxxxxxxx.xx.xxx) and to the Lahontan Water Board (Xxxxxx.Xxxxxx@xxxxxxxxxxx.xx.xxx).
b. The Parties agree that the remaining $75,000 (seventy-five thousand dollars) (SEP amount) of the administrative civil liability shall be conditionally suspended pending completion of the Xxxxxx Basin Excavation portion of the Tahoe Valley Stormwater and Greenbelt Improvement Project (Xxxxxx Basin Supplemental Environmental Project [SEP]) as described herein and in Attachment B, which is hereby incorporated by reference. The Xxxxxx Basin SEP is designed to allow storm water to spread out, infiltrate, and reduce sediment and nutrients, thus improving the quality of the storm water that enters Lake Tahoe. The Xxxxxx Basin SEP is one portion of a larger project which is designed to help meet the sediment and nutrient reductions mandated by the Lake Tahoe Total Maximum Daily Load (TMDL) program.
c. The State Water Board’s Policy on Supplemental Environmental Projects (SEP Policy) states that that the Director of the Office of Enforcement may approve a SEP in an amount greater than 50% of the administrative civil liability in certain cases, including when the SEP is located in, or benefits, a Disadvantaged Community. The Xxxxxx Basin SEP is located in, and will benefit a Disadvantaged Community and therefore the Director has allowed 100% of the liability to fund the SEP.
