Court Leave With Pay. The Company shall grant leave with pay to an employee for the period of time he or she is required:
(a) to be available for jury selection;
(b) to serve on a jury; or
(c) by subpoena or summons to attend as a witness in any proceeding to which he or she is not a party held:
(i) in or under the authority of a court of justice or before a grand jury;
(ii) before a court, judge, justice, magistrate or coroner;
(iii) before the Senate or House of Commons of Canada, or a committee of the Senate or House of Commons, otherwise than in the performance of the duties of his or her position;
(iv) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by law to compel the attendance of witnesses before it;
(v) before an arbitrator or umpire or a person or body of persons authorized by law to make an inquiry and to compel the attendance of witnesses before it, other than an arbitrator appointed under this Collective Agreement or the Canada Industrial Relations Board.

(2) Employees on a day of rest shall receive compensation at the straight time rate for attending subpoenaed inquiries related to an employee's work duties, less any witness fees received. If subpoenaed by the Employer, employees will be compensated in accordance with the overtime article. Employees on a day of rest shall not be entitled to compensation when subpoenaed by the Union.
(3) Except in the case of emergency situations, employees who are required to serve on juries will not be scheduled to work on weekends that fall before or after a full week (Monday to Friday inclusive) in which the employee serves on jury duty. .

Court Leave With Pay. In the event an employee is required by subpoena to attend as a witness in any proceeding held:
a. in or under the authority of a court of justice or before a grand jury;
b. before a court, judge, justice, magistrate or coroner;
c. before the Senate or House of Commons of Canada, or a committee of the Senate or House of Commons, otherwise than in the performance of the duties of his/her position;
d. before the legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by law to compel the attendance of witness before it; or
e. before an arbitrator or umpire or a person or body of persons authorized by law to make an inquiry and to compel the attendance of witnesses before it. The Employer agrees to make up the difference, if any, between the amount paid to him/her for witness fees and the amount he/she would have earned had he/she worked on the day he/she was required to appear as a witness. When an employee is summoned under the circumstances described above, he/she shall notify his/her Employer as soon as possible. Where practical, an employee is required to return to work for the remainder of the day or days when dismissed by counsel or the third party.

B) to serve on a jury, (when an employee is to be paid for jury duty by the Government, the employer shall be reimbursed the equivalent amount the Employee received from the Government for being a juror); or

v) before an arbitrator or umpire or a person or body of persons authorized by law to make an inquiry and to compel the attendance of witnesses before it.
