Common use of Payment on Termination and Abandonment Clause in Contracts

Payment on Termination and Abandonment. (a) When notice is given in accordance with this Agreement, payment to the Employee of all monies due to the Employee, pursuant to this Agreement, will be as per the next pay schedule provided that the Employee has returned their site electronic access card and identification pass plus any issued equipment. (b) Nothing in this clause will affect the Company’s right to dismiss an Employee for misconduct without notice and in such a case the Employee will be paid wages only up until the time of dismissal. (c) Should an Employee have 3 consecutive days of unauthorised absence from work, the Employee will be deemed to have abandoned his/her employment unless, through exceptional circumstances he/she has been unable to communicate his/her absence to the Company.
