Common use of Peak Periods Clause in Contracts

Peak Periods. The first day of a business week and any day on which order volume is greater than 20% above average (calculated on a floating 30-day basis) is defined as a Peak Period. i. FILL shall use best efforts to adhere to the fulfillment policies set forth above during Peak Periods, but its failure to so adhere during Peak Periods shall not be considered a default under this Agreement.
