Pension and Benefit Plan. Pursuant to C.R.S. § 22-30.5-111(3), employees working at the School shall be members of the Public Employees Retirement Association (PERA). No later than the last workday of each month during the term of this Contract, the School shall remit employer and employee contributions directly to XXXX. Such contributions shall be subject to annual revision in accordance with the requirements of the Retirement Plan. PERA rules and regulations shall govern benefits for School employees participating in PERA, as amended from time to time. The School agrees to identify and inform the District and PERA of employees of the School and changes in the identity of employees of the School.

Pension and Benefit Plan. Pursuant to C.R.S. § 00-00-000, in 2004, the DSST was exempted from the “Denver Public Schools Retirement Systems”. DSST did not participate in the “DPS plan” prior to January 1, 2010, and has therefore never participated in the Denver Public Schools Division of PERA. To the extent the Organization is subject to any provisions within C.R.S. 00-00-000, et. Al., the Organization shall be responsible for acquiring and maintaining an exemption from PERA, and DPS shall not be held liable for any pension related payment or penalties on behalf of DSST.
