Common use of Performance Specifications Clause in Contracts

Performance Specifications. All performance specifications will be strictly adhered to in order to provide the highest level of service possible. City reserves the right to monitor Contractor in its performance of the contract to ensure all performance specifications are attained. To receive full compensation, Contractor is required to meet or exceed the following standards of performance on a monthly basis: Operating Performance Standards - Vehicles shall be operated with due regard for the safety, comfort, and convenience of passengers and the general public. Service shall be provided as scheduled or according to any adjusted schedule established by the City including route modifications required as a result of a declared emergency. The Contractor shall strive to maintain on-time performance; however, Contractor shall not be held responsible for the failure to provide on-time service due to weather, unavoidable vehicle malfunction, or externally attributable occurrences, if sufficient documentation is provided to City. Personnel Performance Standards - Regularly assigned drivers must be available at all times during revenue service to ensure consistent and reliable service under the Contract. All personnel are responsible for knowledge of the service. Project personnel must maintain a courteous attitude, answering to the best of their ability, any questions from the public regarding the provision of the service. Customer service training must include a focus on positive customer relations. Personnel must report customer complaints and/or operational problems to the Contractor’s Project Manager who will be responsible for informing the City. Drivers must accurately and completely submit the required operating reports each day.
