Period of QDRO Determination. During any period of time the Administrator, a court of competent jurisdiction or other appropriate person, is determining whether a domestic relations order qualifies as a QDRO, the Administrator shall separately account for the amounts which would be payable to the alternate payee (as defined in Code section 414(p)) if the order is determined to be a QDRO The Administrator may do so by establishing a separate Account for the alternate payee. If the domestic relations order is determined to be a QDRO, if not already established as described above, a separate Account shall be established for the amounts which are payable to the alternate payee. A determination that a domestic relations order is a QDRO made after the close of the 18 month period beginning with the date payments are specified to begin shall be applied prospectively only. Any such separate Account established shall be valued and accounted for in the same manner as any other Account.

  • Employment Period; Remaining Unexpired Employment Period (a) The terms and conditions of this Agreement shall be and remain in effect during the period of employment established under this Section 2 (“Employment Period”). The Employment Period shall be for an initial term of three (3) years beginning on the date of this Agreement and ending on the third anniversary date of this Agreement, plus such extensions, if any, as are provided pursuant to Section 2(b).
