Common use of Position Authorization Clause in Contracts

Position Authorization. As provided under the Civil Service Law, any abolition of positions shall be in the following order: non-veteran; (2) non-disabled veteran; (3) disabled veteran; and reduction of personnel shall be made in the inverse order of the date of their original appointment to the Department, and reactivation to the Department in, the order of their original appointment. Notification of reduction or reactivation of employees shall be made by the Employer to the employee and Union by certified mail, at least seven (7) calendar days prior to such change. Absence from work for a period of two (2) weeks from the date of reactivation shall be considered a resignation from the Department in accordance with Civil Service Law.
