Common use of Position Clause in Contracts

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees to serve the Company in such position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees to serve the Company in such position position, upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board next annual stockholders’ meeting shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, appointed as a member of the Board to fill a directorship and the Director hereby agrees to serve the Company in such that position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s 's continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s 's stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, appointed as non-executive member of the Board of Directors (the “Board”) to fill an existing but now vacant directorship and the Director hereby agrees to serve the Company in such that position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s 's continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s 's stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees to serve the Company in such position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject subjected to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees to serve the Company in such position position, upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board next annual stockholders’ meeting shall be subject to any necessary approval by a majority of the Company’s stockholders.

Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees to serve the Company in such position as a member of the Company’s Board of Directors (the “Board”), upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board next annual stockholders’ meeting shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointedappointed as a member of the Company's Board of Directors, and the Director hereby agrees to serve the Company in such position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board Board, which shall end upon the next annual meeting of the stockholders of the Company, shall be subject to any necessary approval by the Company’s stockholders.

Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, appointed as a non-executive member of the board of directors of the Company (the “Board”) and the Director hereby agrees to serve the Company in such that position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company Director shall cause serve as a member of the Director to be appointed, Board and the Director hereby agrees to serve the Company in such position upon the terms and conditions hereinafter set forthposition, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees to serve the Company in such position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s stockholders. This Agreement shall not derogate from a Director’s rights and benefits under any other agreement, including any employment agreement, with the Company.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, appointed as a member of the Board and Vice Chairman of the Board of Directors and the Director hereby agrees to serve the Company in such that position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s 's continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s 's stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees to serve the Company in such position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees to serve the Company in such position as a member of the Board and Chairman upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board next annual shareholders’ meeting shall be subject to any necessary approval the nomination by the Board and approval of the stockholders of the Company, and the Director’s stockholderscontinued service as Chairman be determined by the Board.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees to serve the Company in such position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service scrvice on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees agrees, to serve the Company in such position upon the terms and conditions hereinafter set forth, ; provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year annual term on the Board Board, which shall end on the next annual meeting of the Company’s stockholders, shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, and the Director hereby agrees to serve the Company in such position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial onesix-year month term on the Board shall be subject to any necessary approval by the Company’s stockholders.

Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, appointed as an executive member of the Board to fill a directorship and the Director hereby agrees to serve the Company in such that position upon the terms and conditions hereinafter set forth, ; provided, however, that the Director’s 's continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s 's stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, appointed as an executive member of the Board of Directors (the “Board”) to renew his directorship and the Director hereby agrees to serve the Company in such that position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, appointed as the Chairwoman of the Board of Directors (the “Board”) to fill an existing but now vacant directorship and the Director hereby agrees to serve the Company in such that position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s 's continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s 's stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, appointed as an executive member of the Board of Directors (the “Board”) and the Director hereby agrees to serve the Company in such that position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointed, appointed as executive member of the Board of Directors (the “Board”) and the Director hereby agrees to serve the Company in such that position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s stockholders.

Position. Subject to the terms and provisions of this Agreement, the Company shall cause the Director to be appointedappointed as Chairman of the Board, and the Director hereby agrees to serve the Company in such position upon the terms and conditions hereinafter set forth, provided, however, that the Director’s continued service on the Board of Directors of the Company (the “Board”) after the initial one-year term on the Board shall be subject to any necessary approval by the Company’s stockholders.

Position.
