Common use of Positions Clause in Contracts

Positions. From and after the Effective Date, the Company shall employ Executive in the position of Chief Operating Officer of the Company and shall cause the Parent to employ Executive as Chief Operating Officer of the Parent, or in such other positions as the parties may mutually agree.

From and after the Effective Date, the Company shall employ Executive in the position of Chief Operating Financial Officer and Treasurer of the Company and shall cause the Parent to employ Executive as Chief Operating Financial Officer and Treasurer of the Parent, or in such other positions as the parties may mutually agree.

From and after the Effective Date, the Company shall employ Executive in the position of Chief Operating Officer Executive Vice President of the Company and shall cause the Parent to employ Executive as Chief Operating Officer Executive Vice President of the Parent, or in such other positions as the parties may mutually agree.

From and after the Effective Date, the Company shall employ Executive in the position of President and Chief Operating Executive Officer of the Company and shall cause the Parent to employ President and Chief Executive as Chief Operating Officer and Secretary of the Parent, or in such other positions as the parties may mutually agree.

From and after the Effective Date, the Company shall employ Executive in the position of Chief Operating Administrative Officer and Assistant Secretary of the Company and shall cause the Parent to employ Executive as Chief Operating Administrative Officer and Secretary of the Parent, or in such other positions as the parties may mutually agree.

From and after the Effective Date, the Company shall employ Executive in the position of Chief Operating Administrative Officer and Secretary of the Company and shall cause the Parent to employ Executive as Chief Operating Administrative Officer and Secretary of the Parent, or in such other positions as the parties may mutually agree.
