POSSESSION AND SURRENDER OF PREMISES. Tenant shall be entitled to possession of the Premises on the 1st day of the Lease Term. At the expiration of the Lease, Tenant shall peaceably surrender the Premises to the Landlord or Landlord’s agent in good condition, as it was at the commencement of the Lease, reasonable wear and tear excepted.
POSSESSION AND SURRENDER OF PREMISES. When this Lease terminates, Tenant will remove from the Premises all of its signs, movable trade fixtures and equipment, inventory and other personal property, whether owned by Tenant or its Affiliates ("Tenant's Property"). Tenant's Property remaining more than five (5) business days after delivery of written notice from Landlord after such termination will be deemed abandoned and Landlord may keep, sell, destroy or dispose of it without any Liabilities to Tenant or its Affiliates. Tenant will repair all damage and surrender the Premises broom clean and in good order, condition and repair, reasonable wear and tear, damage by fire and casualty and taking by eminent domain excepted.

When this Lease expires or otherwise terminates, Tenant will remove all of its signs, movable trade fixtures and equipment, inventory and other personal property owned by Tenant or its Affiliates (“Tenant’s Property”). Notwithstanding anything to the contrary, Tenant will not remove, lease, finance, subject to a security interest or otherwise encumber or Transfer, or damage, Landlord’s Furniture (as defined in Section 11(g) and set forth in Exhibit “G”), or any other items that are attached to the Premises or areas of the Building or realty in such a manner that they are deemed to be “fixtures” under applicable Laws or that are attached in such a manner that their removal would cause substantial damage to or adversely affect the proper and continuing functioning of the Building or its Systems or Equipment. However, notwithstanding the foregoing to the contrary, Tenant will remove those items at the end of the Lease term to the extent that Landlord specifies removal in any written consent to alternations or installation given by Landlord. Tenant will repair all damage caused by such removal or Tenant’s occupancy (reasonable wear and tear and casualty damage excepted) and surrender the Premises broom clean and otherwise in the same condition as on the Rent Commencement Date and as improved in accordance with this Lease (reasonable wear and tear and casualty damage expected). Unless such requirement is specifically waived in writing by Landlord.

Tenant’s Property remaining after termination will be deemed abandoned and Landlord may keep, sell, destroy or dispose of it without incurring any Liabilities to Tenant or its Affiliates. Tenant shall not be required to remove data and telephone cables after the expiration or termination of this Lease. Notwithstanding anything to the contrary, Tenant will not remove items that are attached to the Premises or areas of the Building or the realty in such a manner that they are deemed to be “fixtures” (other than trade fixtures) under applicable Laws or that are attached in such a manner that their removal would cause substantial damage to or adversely affect the proper and continuing functioning of the Building or its Systems or Equipment.

USE OF PREMISES: Tenant shall only use the Premises exclusively for: ASSIGNMENT AND SUBLEASE: Tenant shall not assign or sublease any interest in this Lease without prior written consent of the Landlord. DANGEROUS MATERIALS: Tenant shall not keep or have on or around the Premises any item of a dangerous, flammable or explosive nature that might unreasonably increase the risk of fire or explosion on or around the Premises or that might be considered hazardous by any responsible insurance company.
POSSESSION AND SURRENDER OF PREMISES. When this Lease terminates, Tenant will remove all of its signs, movable trade fixtures and movable computer and other equipment (and wiring integral to such computers and equipment), inventory and other personal property that is not attached to the Building in such a manner as to cause substantial damage to the Building when it is removed ("Tenant's Property"). Notwithstanding the foregoing or anything else to the contrary, Tenant need not remove Tenant's Property from the ground floor data center area, Tenant will not have the right to remove raised flooring that is Tenant's Property if the Lease terminates by reason of any default by Tenant (but if there is not a default Tenant will have the right to remove raised flooring in the Ground Floor data center area on the termination of the Lease), and Tenant will not have the right to remove any ceilings, or any equipment or wiring that would damage the exterior or the structure of the Building or that is integral to or necessary for the proper functioning of the base building Systems and Equipment in the Building. Tenant's Property remaining after termination will be deemed abandoned and Landlord may keep, sell, destroy or dispose of it without incurring any Liabilities to Tenant. In areas of the Building other than the data center, Tenant will repair all damage and surrender the Premises broom clean and in good order, condition and repair, and otherwise in the same condition as on the completion of the initial Landlord's Work and the initial Tenant's Work, normal wear and tear excepted. In the data center, Tenant will repair only damage to the exterior or structure of the Building or the base building Systems and Equipment.

POSSESSION AND SURRENDER OF PREMISES. When this Lease terminates, Tenant shall remove from the Premises all of Tenant's signs, movable trade fixtures, movable furniture, movable computer, movable trade fixtures and other movable telecommunications equipment (and wiring integral to such computers and equipment), inventory and its other movable personal property ("Tenant's Movable Property"), and Tenant shall repair any damage caused by said removal; provided, however, Tenant shall not remove any of Tenant's Movable Property if said removal will substantially damage the Building. Tenant may, but shall not be required, to remove Tenant's Movable Property from the data center area on the ground floor of the Building; and if Tenant does not remove the same it shall be deemed Landlord's property. Tenant's Movable Property does not include, and the following shall be excluded from Tenant's Movable Property and shall not be removed from the Building by Tenant (collectively, "Non-Removed Property"): HVAC, plumbing, cafeteria, or life safety Systems and Equipment, chillers, raised flooring, telephone switches, switch gear and associated cabling, standby generators, paralleling gear, UPS equipment, batteries and all power distribution equipment and associated Systems and Equipment, all of which irrevocably will be deemed to be fixtures and part of the realty that will remain after the expiration or termination of this Lease. Tenant will not have the right to remove, lien, hypothecate or subject Non-Removed Property to a security interest or otherwise Transfer any of the Non-Removed Property or any other fixtures in the Building that are deemed to be part of the realty or any interest therein. Furthermore, Tenant will not have the right to remove any ceilings, or any equipment or wiring that would damage the exterior of the Building or the structure of the Building or remove any equipment or wiring that is integral to or necessary for the proper functioning of the base building Systems and Equipment in the Building, all of which will be deemed fixtures and included in Non-Removed Property. Tenant's Movable Property remaining after termination or expiration of the Lease will be deemed abandoned and Landlord may keep, sell, destroy or dispose of it without incurring any Liabilities to Tenant.
