Possession Tendered - Defined. Possession of the Premises shall be deemed tendered to Lessee ("Tender of Possession") when (1) the improvements to be provided by Lessor under this Lease are substantially completed, (2) the Building utilities are ready for use in the Premises, (3) Lessee has reasonable access to the Premises, and (4) ten (10) days shall have expired following advance written notice to Lessee of the occurrence of the matters described in (1), (2) and (3), above of this paragraph 3.2.1.
Possession Tendered - Defined. Possession of the Premises shall be deemed tendered to Lessee ("Tender of Possession") when (1) the improvements to be provided by Lessor under this Lease are substantially completed.
Possession Tendered - Defined. Possession of the Premises shall be deemed tendered to Tenant ("Tender of Possession") when (1) the improvements to be provided by Landlord under this Lease are substantially completed, (2) the Building utilities are ready for use in the Premises, (3) Tenant has reasonable access to the Premises, and (4) ten (10) days shall have expired following advance written notice to Tenant of the occurrence the matters described in (1), (2) and (3), above of this paragraph 3.2.1.
Possession Tendered - Defined. Possession of the Premises shall be deemed tendered to Tenant ("Tender of Possession") on the Commencement Date as set forth in Section 1.1d, unless otherwise agreed by the parties.
Possession Tendered - Defined the Premises is free from equipment and debris and in a broom-clean condition, (4) Lessor or Lessee's predecessor has obtained regulatory closure of its operations at the Premises, including having performed any necessary cleanup or remediation and having received all necessary authorizations and approvals from regulatory authorities having jurisdiction over such site closure, and (5)
Possession Tendered - Defined. Possession of the Premises shall be deemed tendered to Tenant (“tendered”) when (1) the improvements to be provided by Landlord pursuant to Paragraph 1.14 of this Lease, if any, are substantially completed, (2) the Building utilities are ready for use in the Premises, (3) Tenant has reasonable access to the Premises, and (4) Landlord has given Tenant notice to Tenant of the occurrence of the matters described in (1), (2) and (3), above of this Paragraph 3.
2.1; provided that Landlord’s notice may be given ten (10) or fewer days prior to the date on which possession is tendered.
Possession Tendered - Defined. Provided that Tenant shall not have cancelled this Lease as provided in paragraph 3.2, possession of the Premises shall be deemed tendered to Tenant (“Tender of Possession”) when (i) the improvements to be provided by Landlord under this Lease and the Work Letter are substantially completed in accordance with the Work Letter, except for only minor punch list items, (ii) the Building utilities are ready for use in the Premises, (iii) Tenant has reasonable access to the Premises, and (iv) if required, a Certificate of Occupancy (or its legal equivalent) has been issued by the City of San Diego. Notwithstanding the foregoing, if Tenant is leasing the Premises in its “as-is” condition, then the Tender of Possession shall be deemed to occur on the Target Commencement Date.
Possession Tendered - Defined. Possession of the Premises shall be deemed tendered to Tenant ("Tender of Possession") when (1) the Building utilities are ready for use in the Premises, and (2) Tenant has reasonable access to the Premises. Tenant hereby agrees to accept possession of the Premises "as is," in their present state and condition.
Possession Tendered - Defined. Possession of the Premises shall be deemed tendered to Lessee ("Tender of Possession") when
(1) the existing lessee of the Premises has vacated the Premises, estimated to be on or before January 31, 1999, (2) the Building utilities are ready for use in the Premises, (3) Lessee has reasonable access to the Premises, and (4) ten (10) days shall have expired following advance written notice to Lessee of the occurrence of the matters described in (1), (2) and (3), above of this paragraph 3.2.

Possession Tendered - Defined. Possession of the Premises shall be deemed tendered to Lessee ("Tender of Possession") upon the earlier to occur of (1) the date on which Lessor turns the Premises over to Lessee in its "as is" condition, but free and clear of any occupancy and/or debris and in broom clean condition, provided that, the condition of the Building is such that Tenant's building permit is not delayed by reason of work required to be completed by Lessor pursuant to Section 6.3(a) of this Lease, or (2) the date on which Lessee actually occupies the Premises. Upon Tender of Possession, Lessee shall construct the Tenant Improvements called for by the work letter being entered into by and between Lessor and Lessee, a copy of which is attached hereto as Exhibit C (the "Work Letter").
