POSTING NOTICES OF VACANCIES. a) The Hospital shall post an Internal Notice Opportunity for all full time or regular part-time vacancies on bulletin boards for a period of five (5) calendar days unless in the President & CEO's judgement, an emergency exists that does not allow sufficient time for this procedure to be followed. b) All employees within the same classification and status as stipulated in the Internal Notice Opportunity shall have the right to apply to such vacancies by completing and submitting an Internal Notice Opportunity form. c) The Hospital shall consider same classification and status applicants for the Internal Notice Opportunity based on the seniority provision in this agreement and his/her ability to perform the job. d) The Hospital shall post the resultant vacancy or new jobs on bulletin boards for a period of five (5) calendar days unless in the President & CEO's judgement, an emergency exists that does not allow sufficient time for this procedure to be followed. e) All employees, regardless of classification and status, shall have the right to bid on such vacancies or new jobs. f) The Hospital will consider the applicants and the decision with regard to them shall be based upon the seniority, qualifications, skill, ability and experience as stipulated in the posted vacancy. Where these last four factors are relatively equal, the applicant with the greatest seniority will be given preference provided he/she is qualified to perform the job. g) Where applicants from classifications other than the posted vacancy classification are not relatively equal as outlined in item f of this article then the most senior applicant from the same classification in the posted vacancy, based on the seniority provision in this agreement, will be the successful applicant provided he/she has the ability to perform the job. h) The Hospital will not act in an arbitrary, discriminatory or bad faith manner in making its selection. i) The Hospital agrees to provide the Union with copies of all job postings.

It is understood the Employer and the Union will not prohibit the movement of employees that result in the change of status for the employee. Status is understood to refer to full-time or part-time. 28.05 The Hospital may temporarily fill any vacancy while observing the procedure herein set forth. 28.06 Full time vacancies which are expected to last for less than one year shall be considered temporary vacancies.

POSTING NOTICES OF VACANCIES. a) The 24.1 When the Hospital shall elects to fill a vacancy for a position covered by this Agreement, the Hospital will post an Internal Notice Opportunity for all full time or regular part-time vacancies appropriate notice on bulletin boards the Hospital's website. Such notice shall be posted for a period of no less than five (5) calendar days unless days, excluding Saturdays, Sundays, and holidays before the position is filled. Technical employees interested in the President & CEO's judgement, applying for any vacancy are directed to submit an emergency exists that does not allow sufficient time for this procedure to be followedapplication online. b24.2 Except as otherwise provided herein, any technical employee covered by this Agreement who is qualified for an open position and has completed the probationary period (as defined under Article 7 - Definition of Employee Status) All in their current position may apply for the position. Preference will be given to qualified internal candidates on that unit, who shall be interviewed first. If none of the internal candidates on that unit are qualified and/or selected, the Hospital shall then interview qualified internal applicants from other units. If no qualified employees employed by the Hospital apply for such opening, the Hospital may fill the opening by hiring a new technical employee. The Hospital will attempt to complete the selection process within a reasonable period of time. 24.3 Once a technical employee has posted to, and been accepted for such posted position within another department, the transfer shall, absent unusual circumstances, be made no later than the start of the pay period closest to six (6) weeks from the date of selection. Once this transfer has been effected, the technical employee may not repost for open positions in a different department prior to a period of twelve (12) months from the date of the transfer. Exceptions may be made by mutual agreement of an authorized representative of Staff Council and the Director of Human Resources or designated representative. 24.4 If two or more technical employees apply for the same classification opening and status as stipulated in both meet the Internal Notice Opportunity shall have the right to apply to such vacancies by completing and submitting an Internal Notice Opportunity form. c) The Hospital shall consider same classification and status applicants minimal qualifications set for the Internal Notice Opportunity position, the opening shall be awarded to the most qualified technical employee. The Director for the department or designee shall determine who the most qualified technical employee is based on the seniority provision in this agreement following criteria: work record, education (formal and his/her ability informal), experience, ability, and other criteria which is valid for the position. If two (2) or more technical employees who apply for the same vacancy are equally qualified, the position shall be awarded to perform the jobtechnical employee with the most bargaining unit seniority. d) 24.5 The Hospital electronic listing of all technical employee postings shall post be updated continuously on the resultant vacancy or new jobs electronic job posting site. Upon request made to the Director of Human Resources, Staff Council will be provided with the names of the successful candidates for the vacant, posted positions. Requests shall be made on bulletin boards a timely basis. Requests shall not be made for postings beyond a period of five (5) calendar days unless in the President & CEO's judgement, an emergency exists that does not allow sufficient time for this procedure to be followedthirty day period. e) All employees24.6 Notwithstanding anything to the contrary herein, regardless of classification management may transfer or place technical employees into vacant or newly created positions when it believes it is necessary to do so to comply any federal or state law or regulation, including the Americans With Disabilities Act, and status, shall have the right to bid on such vacancies or new jobsstate workers' compensation statute. f) The Hospital 24.7 Postings will consider the applicants and the decision with regard to them shall be based upon the senioritycontain, qualifications, skill, ability and experience as stipulated in the posted vacancy.
