Potential Regulatory Change. The Company shall keep the Village regularly advised as to potential changes in regulatory requirements affecting the Design/Build Work of which the Company has knowledge, and shall provide recommended responses to such potential changes so as to mitigate any possible adverse economic impact on the Village or the Project should a Change in law actually occur.

The Design-Builder shall keep the Owner regularly advised as to potential changes in regulatory requirements affecting the Design-Build Work of which the Design-Builder has knowledge, and shall provide recommended responses to such potential changes so as to mitigate any possible adverse economic impact on the Owner should a Change in Law actually occur.

The DBOM Contractor shall keep the BWS regularly advised as to potential changes in regulatory requirements affecting the Contract Services of which the DBOM Contractor has knowledge, and shall provide recommended Board of Water Supply, City and County of Honolulu Kalaeloa Seawater Desalination Facility Design-Build-Operate-Maintain Project Service Agreement Article 7 - Design and Permitting of the Project responses to such potential changes so as to mitigate any possible adverse economic impact on the BWS should a Change in Law actually occur.
Potential Regulatory Change. The DBOM Contractor shall keep the BWS regularly advised as to potential changes in regulatory requirements of which the DBOM Contractor has knowledge affecting the Project, and provide recommended responses to such potential changes so as to mitigate any possible adverse technical, compliance or economic impacts on the BWS should a Change in Law actually occur.
Potential Regulatory Change. The Company shall keep the County regularly advised as to potential changes of which the Company obtains knowledge in regulatory requirements affecting the operation and maintenance of the Facilities, and provide recommended responses to such potential changes so as to mitigate any possible adverse economic impact on the County should a Change in Law actually occur.
Potential Regulatory Change. The Company shall keep SRWA regularly advised as to any potential Change in Law affecting the Design-Build Work of which the Company has knowledge, and shall provide recommended responses to such potential changes so as to mitigate any possible adverse economic impact on SRWA should a Change in Law actually occur.
Potential Regulatory Change. The Company shall keep the County regularly apprised as to potential changes in regulatory requirements affecting the landfill industry and the Managed Assets of which the Company has knowledge, and provide recommended responses to such potential changes so as to mitigate any possible adverse economic impact on the County should a Change in Law actually occur. The Company shall participate in performance evaluation surveys conducted by the DENR and EPA.

The Company shall (1) review and keep the Borough regularly advised as to potential changes in regulatory requirements affecting the wastewater treatment industry, the Managed Assets and the Collection System, (2) provid e recomm ended responses to such potential changes so as to m itigate any possible adverse economic impact on the Borough should a Change in Law actually occur, and (3) attend an d participate in meetings and hearings in relation thereto. The Company, at the request of the Borough, shall participate in performance evaluation surveys conducted by the DEP and the EPA.

The Lessee shall (1) review and keep the Lessor regularly advised as to potential changes in regulatory requirements affecting the wastewater treatment industry and the Incineration Facilities, (2) provide recommen ded responses to such potential changes so as to mitigate any possible adverse economic impact on the Lessor should a Change in Law actually occur and (3) attend and participate in meetings and hearings in relation thereto. The Lessee, at the request of the Lessor, shall participate in performance evaluation surveys conducted by the DEP and the EPA.
Potential Regulatory Change. The Company and the WPCA shall keep each other regularly advised as to potential changes in regulatory requirements affecting the System, and provide recommended responses to such potential changes so as to mitigate any possible adverse impact on the WPCA should a Change in Law actually occur. The Company, at the request of the WPCA, shall participate in performance evaluation surveys conducted by CTDEEP and the EPA.
