Common use of POWER AND AUTHORITY OF THE ARBITRATOR Clause in Contracts

POWER AND AUTHORITY OF THE ARBITRATOR. It is understood and agreed that this Agreement constitutes the entire agreement of the parties. Accordingly, the arbitrator shall limit his/her decision strictly to the interpretation or application of the express provision(s) of this Agreement, and shall be without power or authority to make any decision or award: (1) modifying or amending in any way, or inconsistent with the terms of this agreement; (2) which is contrary to law. (3) The decision of the arbitrator shall be final and binding upon all parties.
