PRICE AND MANNER OF PAYMENT. 3.1. The Provider and the Customer have agreed that the price for all performances of the Charging Service shall be specified in the Price List with which the Customer fully agrees. With regard to the expected long- term contractual relationship established by the Contract and with regard to possible changes in market prices (especially electricity prices), the Contracting Parties have agreed that the Provider is entitled to unilaterally change the Price List in the manner and under the conditions specified in the CTC.

PRICE AND MANNER OF PAYMENT. A. The purchase price for the Property shall be a total of Two Million Six Hundred Thousand and NO/100 ($2,600,000) (the "Purchase Price") payable as follows: (i) by payment of $50,000 (the "Deposit") as a deposit; and (ii) the remainder payable at Closing by check or by wire transfer to an account designated by Seller. B The Deposit shall be paid to Mesirov, Gelman, Jaffe, Xxxxxx & Xxxxxxxx (the "Escrow Agent"), who shall deposit that amount in an interest bearing account. The Deposit (with interest) shall be applied against the Purchase Price at Closing. The Deposit shall be forfeited to Seller as Seller's sole remedy and as liquidated damages if Buyer fails to complete this transaction for any reason other than a termination of this Agreement as permitted herein. In the event of such a termination, Seller shall promptly instruct the Escrow Agent to refund the Deposit (with interest) to Buyer and upon the return of the Deposit this Agreement shall wholly cease and terminate and neither party shall have any further claim against the other by reason of this Agreement.
PRICE AND MANNER OF PAYMENT. Pennsauken shall charge Merchantville the rate of: A. Mechanic and Labor Rate, $65.59 per hour. The Township will charge the Borough the cost of parts, material and fluids used at the actual Township purchase price. The Township will maintain a separate time sheet for each Borough owned truck or vehicle serviced under this Agreement. Said time sheet shall document services provided and shall accurately report the labor time for all services rendered pursuant to this Agreement. Payment for services provided to the Borough under this Agreement shall be made monthly to the Township, as per monthly invoices submitted by the Township. As provided by N.J.S.A. 40:8A-7(b), in the event of any dispute as to the amount to be paid under the terms and conditions of this Agreement, the full amount to be paid in accordance with the schedule noted in this paragraph, shall be paid. If through subsequent negotiations, litigation or settlement the amount due shall be determined, agreed to or adjudicated to be less than what was actually so paid; the Township shall promptly refund the Borough the excess.
PRICE AND MANNER OF PAYMENT a) With the exception of Value Added Tax, when applicable, and all other applicable taxes, charges and duties, the price indicated in the Order is fixed and non-adjustable, the Seller expressly waiving its rights under article 1664 of the Italian Civil Code.
