PROCEDURES AND STEPS. Within twenty (20) calendar days, excluding winter break, following the act or condition which is the basis of complaint, an employee may file a grievance with the employee's Manager or Food Services Supervisor. Prior to filing the written grievance every effort shall be made to solve the grievance informally between the grievant and the grievant's Manager or Food Services Supervisor. STEP 1 If the grievance has not been resolved informally as referred to above, a written grievance may be presented to the employee's Manager or immediate supervisor. Within ten (10) duty days thereafter the Manager or immediate supervisor to whom the grievance was presented or a designated representative shall meet with the grievant and give a written decision to the grievance. STEP 2 If the grievance is not settled in Step 1, the grievant may move it to Step 2 by written notice within ten (10) duty days to the Superintendent of Schools or his designated representative. The Superintendent of Schools or designated representative shall have ten (10) duty days after receipt of the grievance to meet with if necessary and give a written decision to the grievant. STEP 3 - ARBITRATION If the grievance is not settled in Step 2, the Executive Council may move the matter to arbitration under the Voluntary Labor Arbitration Rules of the American Arbitration Association upon written notice to the board within fifteen (15) duty days following the Step 2 decision. The parties further agree to accept the arbitrator's award as final and binding upon them. The arbitrator shall have no power to add to, subtract or modify any of the terms of this Agreement or to make any award which is beyond the terms of this Agreement or to make any award which in any way deprives the Board of any of the powers delegated to it by law.

STEP 3 - ARBITRATION If the grievance is not settled in Step 2, the Executive Council Association alone may move the matter to arbitration under the Voluntary Labor Arbitration Rules of the American Arbitration Association upon written notice to the board Board within fifteen (15) duty 15 days following the Step 2 decision. The parties further agree to accept the arbitrator's award as final and binding upon them.
