PROCUREMENT IMPLICATIONS. 7.1 As set out in the body of the report, the extension and variation of these services is an interim measure in order to allow a tender process to conclude. The procurement strategy for the tender of ASC Advocacy services named in this report was approved in accordance with LBHF Contract Standing Orders in May 2013.
PROCUREMENT IMPLICATIONS. 11.6.1 At this time a majority of the procurement decisions will continue to be undertaken by the Council and managed by Lambeth Living through delegated budgets. This includes at this time all of the Partnership contracts that are being tendered currently which have a value in the region of £40m plus per annum. However before these go live the Council will need to decide whether to continue to delegate the management of such contracts and delegated council oracle use for raising orders and payments by Xxxxxxx Living, or to give them further delegated authority to pay directly from their organisation, and the payments from the Council become part of the Management Fee.

These services will require delegated authority to be granted to award contracts at short notice by the Director of Integrated Commissioning to ensure that vulnerable children are not waiting to be placed in appropriate xxxxxx, SEN placements and residential care.

  • FINANCIAL IMPLICATIONS There are no budget implications. The applicant will be responsible for all costs, expenses, liabilities and obligations imposed under or incurred in order to satisfy the terms of this proposed development agreement. CONSULTANT further represents and warrants that no payment, gift or thing of value has been made, given or promised to obtain this or any other agreement between the parties. CONSULTANT makes such representations and warranties to induce the COUNTY to enter into this Agreement and the COUNTY relies upon such representations and warranties in the execution hereof. For a breach or violation of such representations or warranties, the COUNTY shall have the right to annul this Agreement without liability, entitling the COUNTY to recover all monies paid hereunder and CONSULTANT shall not make claim for or be entitled to recover, any sum or sums otherwise due under this Agreement. This remedy, if effected, shall not constitute the sole remedy afforded the COUNTY for such falsity or breach, not shall it constitute a waiver of the COUNTY’s right to claim damages or otherwise refuse payment or to take any other action provided for by law or pursuant to this Agreement.

  • Modified Indemnity Where Agreement Involves Design Professional Services Notwithstanding the forgoing, if the services provided under this Agreement are design professional services, as defined by California Civil Code section 2782.8, as may be amended from time to time, the defense and indemnity obligation under Section 1, above, shall be limited to the extent required by California Civil Code section 2782.8.
