Product Measurements. The quantity of Product throughput through the Pipelines shall be based on Gross Standard Volume (GSV) using the applicable API and ASTM or equivalent standards as follows: (i) for the portion of the Marine Vessel receipt and/or load volume delivered to or received from the Refinery by the Pipelines, the Pipeline movement volume will be determined by: (A) by meters; (B) by static shore tank gauges of the tank; and (C) otherwise by a mutually agreeable method; and (ii) for Marine Vessel discharge or load volume which is delivered to or received from third party pipelines, terminals or the Wilmington Refinery, the Pipeline movement volume will be determined by the difference between the total volume discharged from or loaded to the Marine Vessel less the volume delivered to or received from a third-party pipeline or terminal. Customer shall provide Operator with all reasonable documentation with respect to the volumes throughput across the Berths, including but not limited to, inspection reports, meter tickets or other similar documentation within three (3) Business Days of completion of Marine Vessel discharge.

Product Measurements. Measurement of Product into and out of storage shall be made in accordance with the procedures and methods set out in Exhibit “B” attached hereto and incorporated herein by this reference. Subject to Section 8 below, whenever a Well is physically emptied of Product, Lessor shall determine, from available measurement and sampling records, the overages and/or underages of Product. Except for losses which are the responsibility of Lessor pursuant to Section 8 of this Lease, Lessor shall adjust Lessee’s account to reflect any overages and/or underages of Product. All Product gains and losses incurred while the product is under Lessor’s control shall be for the account of Lessee except as noted in Section 14. Lessor shall submit to Lessee monthly stock reports supported with appropriate receiving and shipping information showing movements of Product into and out of storage and the amount of Product remaining in storage.
Product Measurements. All quantities of Products received and delivered into or by the SoCal Pipelines shall be measured by the following (in order of preference), subject to TSPC’s reasonable discretion to choose an alternative method: (i) by meters, (ii) if applicable, by static shore tank gauges of the tank or otherwise or (iii) by a mutually agreeable method. All quantities shall be adjusted to net gallons at 60° F in accordance with ASTM D-1250 Petroleum Measurement Tables, or latest revisions thereof. Meters and temperature probes shall be calibrated according to applicable API standards in accordance with customary industry procedures. TRMC shall have the right, at its sole expense, and in accordance with applicable Segment procedure, to independently certify such calibration.
Product Measurements. 18.1 The volume of Product supplied for any purposes in terms of or under this Agreement, shall be measured: 18.1.1 where Product is delivered as a sealed parcel, by taking the Product quantity reading, in litres from a xxxx of lading, generated at the loading point from a temperature compensated flow meter register with print-out capabilities; and 18.1.2 where Product is delivered as an unsealed parcel, by taking the Product quantity reading, in litres from a print-out, generated by a temperature compensated flow meter register with print-out capabilities, connected to the RTL. 18.2 The readings taken strictly in accordance with agreed procedures shall constitute prima facie proof of Product volumes supplied. 18.3 The Supplier shall ensure that the delivery trucks that are utilised for all deliveries by road are metered and have operational printing capabilities. 18.4 Billing and invoicing in respect of the supply of Product under or in terms of this Agreement shall in all instances be based on measurement in terms of the provisions contained in clause 18.1 above. 18.5 Transnet reserves the right to not accept any delivery of Product that exceeds a 2% (two percent) variance between the xxxx of lading and the delivery truck meter. Upon discovery of a variance that exceeds 2% (two percent), Transnet reserves the right to investigate such a variance prior to acceptance of the delivery of Product. 18.6 The Oil Company shall at all times during the currency of this Agreement ensure that all measurement instruments used for the dispensing of Product in terms of or under this Agreement: 18.6.1 are correct, accurate and in good working order; 18.6.2 are calibrated annually; and 18.6.3 comply with the requirements of the Legal Metrology Act No 9 of 2014, as amended. And Transnet shall be entitled at any point in the currency of this Agreement to request a copy of the valid calibration certificates.

  • Measurements Units set out in SI (metric) are the governing units for the purposes of this Contract. Units set out in Imperial measurement in parentheses beside their SI (metric) equivalent are for reference only and in the event of a conflict between SI (metric) and Imperial measurement herein, SI (metric) shall prevail.

  • Interim Measures Notwithstanding any requirements for alternative dispute resolution procedures as set forth in Articles 18(B), any party to the Dispute may apply to a court for interim measures (i) prior to the constitution of the arbitral tribunal (and thereafter as necessary to enforce the arbitral tribunal’s rulings); or (ii) in the absence of the jurisdiction of the arbitral tribunal to rule on interim measures in a given jurisdiction. The Parties agree that seeking and obtaining such interim measures shall not waive the right to arbitration. The arbitrators (or in an emergency the presiding arbitrator acting alone in the event one or more of the other arbitrators is unable to be involved in a timely fashion) may grant interim measures including injunctions, attachments and conservation orders in appropriate circumstances, which measures may be immediately enforced by court order. Hearings on requests for interim measures may be held in person, by telephone, by video conference or by other means that permit the parties to the Dispute to present evidence and arguments.

  • Temperature Measurement Temperature will be measured by the nearest automatic Melbourne Bureau of Meteorology Monitoring Station for example (but not limited to): Melbourne, Moorabbin, Dunns Hill, Melbourne Airport, Frankston, and Point Xxxxxx. At the commencement of each project, the onsite management and employee representatives shall agree which is to be the applicable automatic weather monitoring station.

  • Measuring EPP parameters Every 5 minutes, EPP probes will select one “IP address” of the EPP servers of the TLD being monitored and make an “EPP test”; every time they should alternate between the 3 different types of commands and between the commands inside each category. If an “EPP test” result is undefined/unanswered, the EPP service will be considered as unavailable from that probe until it is time to make a new test.

  • Performance Measurement The Uniform Guidance requires completion of OMB-approved standard information collection forms (the PPR). The form focuses on outcomes, as related to the Federal Award Performance Goals that awarding Federal agencies are required to detail in the Awards.

  • Measuring DNS parameters Every minute, every DNS probe will make an UDP or TCP “DNS test” to each of the public-­‐DNS registered “IP addresses” of the name servers of the domain name being monitored. If a “DNS test” result is undefined/unanswered, the tested IP will be considered unavailable from that probe until it is time to make a new test.
