Professional Services Warranties. Appgate warrants that (i) it and the Appgate personnel performing the Professional Services have the necessary knowledge, skills, experience, and qualifications to perform the Professional Services in accordance with the applicable Order Form(s), and (ii) the Professional Services will be performed in a professional and workmanlike manner in accordance with generally accepted industry standards.
Professional Services Warranties. Oracle warrants that (i) the Deliverables will substantially conform to the Statement of Work; and (ii) the Professional Services will be performed with reasonable skill, care and diligence consistent with industry standards. The remedies set out in this Section 5 are Customer’s exclusive remedies for breach of either warranty.
5.1. If the Professional Services do not conform to the Statement of Work or are not performed with reasonable skill, care and diligence consistent with industry standards, Oracle shall re-perform the Professional Services to the extent necessary to correct the deficient services. If Oracle cannot substantially correct a breach in a commercially reasonable manner, Customer may end the relevant services and recover the fees Customer paid to Oracle for the deficient services.
Professional Services Warranties. AppGate warrants that (i) it and the AppGate personnel performing the Professional Services have the necessary knowledge, skills, experience, and qualifications to perform the Professional Services in accordance with the applicable Order Form(s), and (ii) the Professional Services will be performed in a professional and workmanlike manner in accordance with generally accepted industry standards.
Professional Services Warranties. 5.5.1. DocStar represents and warrants the Professional Services will be provided by qualified personnel with reasonable skill and care in accordance with generally accepted industry standards and in accordance with the applicable Order.
5.5.2. Provided Customer notifies DocStar in writing within the Professional Services Warranty Period and DocStar validates the nonconformity, Customer’s sole and exclusive remedy for breach of the warranties described herein will be for DocStar to re-perform the defective Professional Services in a reasonably timely manner at no additional cost to Customer. 5.6. Customer Responsibilities. Customer will provide DocStar with reasonable access to requested resources such as: (i) Customer’s personnel, facilities, equipment, hardware, software, network and information for Professional Services performed onsite, and (ii) timely decision-making, notification of relevant issues or information and the granting of approval or permissions as reasonably necessary for DocStar to perform the Professional Services whether or not onsite.
Professional Services Warranties. Traumasoft warrants that (i) the Work Product will substantially conform to the specifications set forth in Statement of Work; and (ii) the Professional Services will be performed with reasonable skill, care and diligence. The remedies set out in Section 5.1 are Customer’s exclusive remedies for breach of either warranty.
5.1. If the Professional Services do not conform to the Statement of Work or are not performed with reasonable skill, care and diligence, Traumasoft shall re-perform the Professional Services to the extent necessary to correct the defective performance.
Professional Services Warranties. PickNik will perform those Professional Services set forth in a Statement of Work. PickNik warrants to Customer that any Professional Services will be performed in a professional manner consistent with industry standards. PickNik shall, as its sole obligation and Customer’s sole and exclusive remedy for any breach of this warranty, re-perform the Professional Services which gave rise to the breach, or, at PickNik’s option, refund the Fees paid by Customer for the portion of the Professional Services that did not fulfill such warranty, provided that Customer shall notify PickNik in writing of the breach within thirty (30) days following performance of the defective Professional Services specifying the breach in reasonable detail.

Novoville warrants that (i) the Professional Services shall substantially conform to the applicable Order Form; and (ii) the Professional Services shall be performed with reasonable skill, care and diligence. The remedies set out in this Clause 9 are the Customer’s exclusive remedies for breach of either warranty. If the Professional Services do not conform to the Order Form or are not performed with reasonable skill, care and diligence, Novoville shall re-perform the Professional Services to the extent necessary to correct the defective performance.
6.2. Novoville shall comply with the terms of the SLA (or as amended in an Order Form) at all times. The terms of Clause 9.1 shall apply to the SLA.

Viva City warrants that (i) the Professional Services shall substantially conform to the applicable Order Form; and (ii) the Professional Services shall be performed with reasonable skill, care and diligence. The remedies set out in this Clause 9 are the Customer’s exclusive remedies for breach of either warranty. If the Professional Services do not conform to the Order Form or are not performed with reasonable skill, care and diligence, Viva City shall re-perform the Professional Services to the extent necessary to correct the defective performance.
9.2. Viva City shall comply with the terms of the SLA (or as amended in an Order Form) at all times. The terms of Clause 9.1 shall apply to the SLA.
Professional Services Warranties. JFrog represents and warrants that it will perform the Professional Services in a diligent manner in accordance with (i) industry best standards and practices; and (ii) all material requirements set forth in the SOW.
