Promotions, Demotions and Transfers. A. In making promotions, demotions, or transfers, the required knowledge, ability and skills for the positions shall be the primary consideration. Where an employee applies for promotion, demotion or transfer and has the knowledge to fill the vacancy, the employee shall be given the opportunity to prove ability and skills in the position, provided that: 1. The employee has not been employed in a position with the Board where they have demonstrated this ability and skills for such a position, and 2. The employee has seniority over all other applicants. 3. Where two or more applicants are capable of fulfilling the duties of the position, seniority shall be the determining factor provided always that current service employees shall be given preference over any other type of applicants. 4. For Supervisor I, II, III & IV positions, the employer will interview and test the four (4) most senior applicants possessing qualifications for the posted position. Selection for the position will then be based on knowledge, ability and skills. B. In the event of layoffs, the employee with the least seniority shall be the first laid off. C. It is further understood and agreed that the employees concerned retain the right to appeal under the grievance procedure contained in this Agreement. D. If a regular employee is promoted or transferred or demoted to a classification for which the Union is the certified bargaining authority, then the promoted employee shall be considered an employee "on trial" for a period of thirty (30) working days exclusive of holidays, leaves of absence and illness. E. In the event an employee who is promoted, demoted or transferred (to a different classification) proves unsatisfactory or is dissatisfied during the aforementioned period, they shall be returned to their former position or to a position of equal status if the former position no longer exists, without loss of seniority or salary and any other employee promoted or transferred because of the rearrangement of positions shall, if necessary, be returned to their former position without loss of seniority or salary. Application for transfer, as outlined in paragraph H, shall not apply to employees returned to a position of "equal status". F. Any employee promoted or transferred or demoted into a different classification may be required to stay in the position for a period of fifteen (15) working days, notwithstanding that they may have expressed dissatisfaction with the position. If the employee returns to their original position or leaves the employ of the Board within the above-mentioned "on trial" G. If a regular employee transfers within the same classification and if the employee is dissatisfied with the new position(s) they may revert to their former position within five (5) working days. If the employee chooses to revert back, the posting file will be reopened once. If this reopening does not produce a successful candidate the position will be reposted. H. Where an employee requests and receives a permanent transfer from one place of work to another, such employee shall not be eligible to apply for another permanent transfer for a period of twelve (12) months following the effective date of transfer. Employees who wish to revert back as outlined in E and G above shall not be entitled to do so if they have exercised this option during the previous twenty-four (24) months. However, it is understood and agreed that the Board may at its discretion initiate transfers during the aforementioned periods. This provision shall not prohibit an employee making an application for promotion. I. Education Assistants shall not be eligible to apply for another permanent transfer, into another Education Assistant position with the same hours, until June of each year.

If a regular employee is promoted or transferred or demoted to a classification for which the Union is the certified bargaining authority, then the promoted employee shall be considered an employee "on trial" Authority bulletin board for a period of thirty ten (3010) calendar days, within three (3) working days exclusive of holidaysthe official approval to such openings by the Authority. C. Employees interested in such job openings shall make application in writing to the Executive Director within ten (10) calendar day time period. D. Employees with classification seniority, leaves if applicable, followed by employees with Authority seniority shall be given job preference provided they have the experience or ability and physical capability in the opinion of absence and illnessthe Authority to perform the job requirements. E. In Any employee placed in a new or vacant job position shall be on a trial period for ninety (90) calendar days. Holidays which fall within this period and are part of this agreement will not be considered within the event an employee who is promotedninety (90) calendar day period. Sick time, demoted injury and other periods of personal leave will be included within this time frame. If during, or transferred (to a different classification) proves unsatisfactory or is dissatisfied during at the aforementioned end of the trial period, they the Authority determines that the employee does not qualify, the employee and the Union shall be notified with an explanation for the reason. A disqualified employee shall be returned to their former position her or to a position his original job classification and retain original job seniority and rate of equal status if the former position no longer exists, without loss of seniority or salary and any other employee promoted or transferred because of the rearrangement of positions shall, if necessary, be returned to their former position without loss of seniority or salary. Application for transfer, as outlined in paragraph H, shall not apply to employees returned to a position of "equal status"pay. F. Any An employee promoted serving ninety (90) calendar days probation period in a new or transferred or demoted into a different classification may vacant job position shall receive the starting salary rate of the particular job classification. G. Temporary promotions shall be required offered to stay in the position for a period of fifteen (15) working days, notwithstanding that they may have expressed dissatisfaction qualified employees with the position. If the employee returns to their original position or leaves the employ of the Board within the above-mentioned "on trial" G. If a regular employee transfers within the same most job classification and if the employee is dissatisfied with the new position(s) they may revert to their former position within five (5) working days. If the employee chooses to revert back, the posting file will be reopened once. If this reopening does not produce a successful candidate the position will be repostedseniority. H. Where Nothing contained herein shall prevent the Authority from hiring new employees to fill new or vacant positions, if in the opinion of the Authority present employees do not fill the particular job requirements. I. If an employee requests and receives a permanent transfer from one place is on the extended injury or sick leave, or leave of work to anotherabsence, such employee shall not be eligible to apply for another permanent transfer for a period of twelve (12) months following the effective date of transfer. Employees who wish to revert back as outlined in E and G above shall not be entitled to do so if they have exercised this option during the previous twenty-four (24) months. However, it is understood and agreed that the Board Authority may at its discretion initiate transfers during option, hire a temporary employee as a replacement to insure normal plant operations. J. The Authority shall notify the aforementioned periods. This provision Union in writing in the event of the hiring or change of employment status of any new or incumbent employee. K. The Authority shall not prohibit an employee making an application hire part-time employees, except for promotionspecial need projects of the Authority. I. Education Assistants shall not be eligible to apply for another permanent transfer, into another Education Assistant position with the same hours, until June of each year.
