PROPOSED CRITICAL WORKS. 1.1 If the Tenant proposes to carry out or make any variation to any Notifiable Works which may include Critical Works it shall before commencing the same serve upon the Landlord a proposal fully and fairly detailing the proposed Works and drawing attention to any Works which in the reasonable opinion of the Tenant may be Critical Works and indicating whether the Work is or is not urgent and the reasons for such assessment 1.2 Within thirty (30) Business Days (which for the avoidance of doubt will run concurrently with the time period set out in Clause 6.4 of this Lease) of receipt of a proposal pursuant to paragraph 1.1, the Landlord will serve upon the Tenant notification in writing that: (a) the proposed Works do not include Critical Works in which case this schedule shall not apply insofar as the Works were fully and fairly described in the proposal and the Landlord's attention was drawn to any Works which in the reasonable opinion of the Tenant may be Critical Works or (b) the proposed Works do include Critical Works in which case this schedule shall apply (and the Landlord shall indicate which of the provisions of this schedule are to apply to the proposed Critical Works) or (c) it requires further information from the Tenant to assist in deciding whether or not the proposed Works include Critical Works 1.3 Within twenty (20) Business Days of receipt of the further information referred to in paragraph 1.2(c) the Landlord shall notify the Tenant in writing whether or not the proposed Works include Critical Works and if they do which of the provisions of this schedule are to apply to the proposed Critical Works 1.4 The notification by the Landlord pursuant to this paragraph 1 as to whether the proposed Works include Critical Works and the extent of the Critical Works and the application of this schedule shall be conclusive

  • Scope of Works (a) Users with an appropriate licence type may be able to create and access Scope of Works. (b) The parties acknowledge and agree that: (i) any wording contained in a Scope of Works is established by the Customer, is customisable and within the Customer's absolute control; (ii) Users make decisions within ProcurePro on how to draft Scope of Works and ProcurePro is not responsible for those decisions; (iii) the Supplier is not liable for the Customer's use or reliance upon any Scope of Works; and (iv) the Supplier is not responsible for controlling the use, copying, modification or export of a Scope of Works by any User to which the Customer allows access to that Scope of Works.

  • Research Use Reporting To assure adherence to NIH GDS Policy, the PI agrees to provide annual Progress Updates as part of the annual Project Renewal or Project Close-out processes, prior to the expiration of the one (1) year data access period. The PI who is seeking Renewal or Close-out of a project agree to complete the appropriate online forms and provide specific information such as how the data have been used, including publications or presentations that resulted from the use of the requested dataset(s), a summary of any plans for future research use (if the PI is seeking renewal), any violations of the terms of access described within this Agreement and the implemented remediation, and information on any downstream intellectual property generated from the data. The PI also may include general comments regarding suggestions for improving the data access process in general. Information provided in the progress updates helps NIH evaluate program activities and may be considered by the NIH GDS governance committees as part of NIH’s effort to provide ongoing stewardship of data sharing activities subject to the NIH GDS Policy.

  • Research Independence The Company acknowledges that each Underwriter’s research analysts and research departments, if any, are required to be independent from their respective investment banking divisions and are subject to certain regulations and internal policies, and that such Underwriter’s research analysts may hold and make statements or investment recommendations and/or publish research reports with respect to the Company and/or the offering that differ from the views of its investment bankers. The Company hereby waives and releases, to the fullest extent permitted by law, any claims that the Company may have against such Underwriter with respect to any conflict of interest that may arise from the fact that the views expressed by their independent research analysts and research departments may be different from or inconsistent with the views or advice communicated to the Company by such Underwriter’s investment banking divisions. The Company acknowledges that the Representative is a full service securities firm and as such from time to time, subject to applicable securities laws, may effect transactions for its own account or the account of its customers and hold long or short position in debt or equity securities of the Company.

  • MSAA Indicator Technical Specification Document This Agreement shall be interpreted with reference to the MSAA Indicator Technical Specifications document.

  • Project Scope The physical scope of the Project shall be limited to only those capital improvements as described in Appendix A of this Agreement. In the event that circumstances require a change in such physical scope, the change must be approved by the District Committee, recorded in the District Committee's official meeting minutes, and provided to the OPWC Director for the execution of an amendment to this Agreement.

  • Scope of Work For the 2022/2023 Grant Period, the Provider will maintain a victim services program that will be available to provide direct services to victims of crime who are identified by the Provider or are presented to the Provider, as specified in the Provider’s 2022/2023 Grant Application as approved by the OAG and incorporated herein by reference.

  • Technical Specifications The Technical Specifications furnished on the CD are intended to establish the standards for quality, performance and technical requirements for all labor, workmanship, material, methods and equipment necessary to complete the Work. When specifications and drawings are provided or referenced by the County, these are to be considered part of the Scope of Work, and to be specifically documented in the Detailed Scope of Work. For convenience, the County supplied specifications, if any, and the Technical Specifications furnished on the CD.

  • 000 SCOPE OF WORK 5. 100 The scope of this Agreement covers all work of a maintenance, repair and renovation nature, assigned by the Owner to the Company and performed by the employees of the Company covered by this Agreement, within the limits of the Owner's plant site.

  • Project Specific Milestones In addition to the milestones stated in Section 212.5 of the Tariff, as applicable, during the term of this ISA, Interconnection Customer shall ensure that it meets each of the following development milestones: 6.1 Substantial Site work completed. On or before December 31, 2020 Interconnection Customer must demonstrate completion of at least 20% of project site construction. At this time, Interconnection Customer must submit to Interconnected Transmission Owner and Transmission Provider initial drawings, certified by a professional engineer, of the Customer Interconnection Facilities. 6.2 Delivery of major electrical equipment. On or before December 31, 2021, Interconnection Customer must demonstrate that all generating units have been delivered to Interconnection Customer’s project site.
