Protection from Suit. To the extent required by the Illinois School Code, the Board shall indemnify and protect bargaining unit members against civil rights damage claims and suits, constitutional rights damage claims and suits and death and bodily injury and property damage claims, suits, including defense thereof, when damages are sought for negligent or wrongful acts alleged to have been committed in the scope of employment or under the direction of the Board. Such indemnification and protection shall extend to persons who were members of the bargaining unit at the time of the incident from which a claim arises. No bargaining unit member may be afforded indemnification or protection unless they were a member of the bargaining unit at the time of the incident from which the claim arises.

Protection from Suit. Pursuant to School Codes Section 10.20.20, the School Board will provide legal counsel and necessary assistance to defend teachers, acting within the scope of their authority, against civil claims brought by parents. This protection does not extend to criminal defense since criminal activity is outside the teachers’ scope of authority.

No agent may be afforded indemnification or protection unless he was a member of a school board, an employee of a board, an authorized volunteer, a mentor of certified staff, or a student teacher at the time of the incident from which the claim arises.
Protection from Suit. The BOARD shall indemnify and protect TEACHERS against death and bodily injury and property damage claims and suits, including defense thereof, when damages are sought for negligent or wrongful acts alleged to have been committed in the scope of employment or under the directions of the BOARD. Such indemnification and protection shall extend to persons who were TEACHERS at the time of the incident from which a claim arises.
Protection from Suit. The Board shall abide by, and shall afford teachers indemnification and protection from claims and suits pursuant to, all applicable laws, including 105 ILCS 5/10-20.20 [Protection from Suit] and 105 ILCS 5/10-22.3 [Liability Insurance for School Board Members, School Board Employees and Student Teachers].

  • Separation from Service A termination of employment shall not be deemed to have occurred for purposes of any provision of this Agreement providing for the payment of any amounts or benefits upon or following a termination of employment unless such termination also constitutes a “Separation from Service” within the meaning of Section 409A and, for purposes of any such provision of this Agreement, references to a “termination,” “termination of employment,” “separation from service” or like terms shall mean Separation from Service.

  • Separation from Employment Employees who leave the District with a vacation balance shall have their vacation balance cashed out. If vacation is loaded on July 1st, the vacation balance shall be pro-rated prior to cash out.
