Provide Data In Compliance With FERPA. School Unit shall provide data for the purposes of the Service Agreement in compliance with FERPA, COPPA, PPRA, IDEA, MSIPA, and MUSER and all other Maine privacy statutes and regulations referenced or identified in this DPA.

Provide Data In Compliance With FERPA. LEA shall provide data for the purposes of the Service Agreement in compliance with the Family Educational Rights and Privacy Act ("FERPA"), 20 U.S.C. section 1232 g, AB 1584 and the other privacy statutes quoted in this DPA.

If Partner School provides Education Records to Summit Learning, Partner School represents, warrants and covenants to Summit Learning, as applicable, that Partner School has: a. complied with all applicable provisions of FERPA relating to disclosures to school officials with a legitimate educational interest, including, without limitation, informing parents in their annual notification of FERPA rights that the Partner School defines “school official” to include service providers and defines “legitimate educational interest” to include services such as the type provided by Summit Learning; or b. obtained all necessary parental or eligible student written consent to share the Student Data with Summit Learning, in each case, solely to enable Summit Learning’s operation of the Services. Partner School represents, warrants, and covenants to Summit Learning that it shall not provide information to Summit Learning from any student or parent/legal guardian that has opted out of the disclosure of Directory Information. Summit Learning depends on Partner School to ensure that the Partner School is complying with the FERPA provisions regarding the disclosure of any student information that will be shared with Summit Learning.
Provide Data In Compliance With FERPA. If LEA provides Pupil Records for the purposes of the Service Agreement it shall do in a manner that complies with the including FERPA, COPPA, PPRA, AB 1584, and SOPIPA and all other privacy statutes identified in this DPA.

If Partner School provides Education Records to RCA, Partner School represents, warrants and covenants to RCA, as applicable, that Partner School has: a. complied with all applicable provisions of FERPA relating to disclosures to school officials with a legitimate educational interest, including, without limitation, informing parents in their annual notification of FERPA rights that the Partner School defines “school official” to include service providers and defines “legitimate educational interest” to include services such as the type provided by RCA; or b. obtained all necessary parental or eligible student written consent to share the Student Data with RCA, in each case, solely to enable RCA’s operation of the System. RCA depends on Partner School to ensure that the Partner School is complying with the FERPA provisions regarding the disclosure of any student information that will be shared with RCA.

  • Provide Data in Compliance with Applicable Laws LEA shall provide Student Data for the purposes of obtaining the Services in compliance with all applicable federal, state, and local privacy laws, rules, and regulations, all as may be amended from time to time.

  • COMPLIANCE WITH BREACH NOTIFICATION AND DATA SECURITY LAWS Contractor shall comply with the provisions of the New York State Information Security Breach and Notification Act (General Business Law § 899-aa and State Technology Law § 208) and commencing March 21, 2020 shall also comply with General Business Law § 899-bb.

  • Provide Data In Compliance With State and Federal Law LEA shall provide data for the purposes of the Service Agreement in compliance with FERPA, COPPA, PPRA, Texas Education Code Chapter 32, and all other Texas privacy statutes cited in this DPA as these laws and regulations apply to the contracted services. The LEA shall not be required to provide Data in violation of applicable laws. Operator may not require LEA or users to waive rights under applicable laws in connection with use of the Services.
