Common use of Public Holidays and termination Clause in Contracts

Public Holidays and termination. If the employer gives to an employee a notice of termination taking effect within seven days of the date on which any of the listed holidays fall or are observed, the employer shall pay the employee a day's pay for each such holiday unless the reason for the termination is the misconduct of the employee. This sub clause shall not apply to any employee who at the date of termination has not been employed by the employer for at least 80 percent of the ordinary working time of the three consecutive weeks immediately preceding the termination. This provision will not apply in the case of a holiday observed on a non-working day.
