Common use of Purge of Personnel File Clause in Contracts

Purge of Personnel File. Any written reprimand, including documented verbal reprimands, shall be removed from the employee’s record, if, from the date of the last reprimand, twelve (12) months have passed without the employee receiving an additional reprimand or discipline for the same or substantially similar offenses. The employee shall submit a request at the end of the twelve (12) month period for the removal of the reprimand from his file.

The employee shall submit a request at the end of the twelve (12) month period for parties agree that the removal of reprimand shall be on the reprimand from his filewritten notice of the affected employee. Not withstanding the above, record of such discipline may be introduced when relevant at a disciplinary proceeding before the Board of Fire and Police Commissioners or arbitrator, whichever is applicable.
