Common use of Qualifying Events Clause in Contracts

Qualifying Events. a. FMLA leave entitlement will be given for any of the following qualifying reasons: 1) Birth of the teacher’s child, or the placement of a child for adoption or xxxxxx care, and first-year care of the child. 2) To care for the teacher’s spouse, child, or parent who has a serious health condition. 3) For a serious health condition that causes the teacher to be unable to perform his/her job. b. Leaves may begin before the birth of a child if a medical condition exists that makes the teacher unable to perform the job or prior to the placement of a child for adoption or xxxxxx care if circumstances require absence from work for the placement to proceed. A teacher’s entitlement to leave for the birth or placement of a child expires at the end of the twelve (12) month period beginning on the date of the birth or placement.
