Railroad Rights. Lessee shall have the non-exclusive right to use any railroad right-of-way on, adjacent to, or serving the Surface Property pursuant to any agreement now or hereafter entered into by Lessor (subject to Lessor’s right to grant the same) with the rail carrier, or pursuant to Lessee’s own agreement with such rail carrier.
