Re-Mailing of Returned Settlement Notices. Any Notices that are returned as non-deliverable with a forwarding address shall promptly be re-mailed by the Claims Administrator to such forwarding address.

Re-Mailing of Returned Settlement Notices. The Claims Administrator will promptly re-mail any Notices that are returned as non-deliverable with a forwarding address to such forwarding address. For all returned mail, the Claims Administrator will perform data searches and other reasonable steps to attempt to obtain better contact information on the Settlement Class Member. All costs of such research will be considered Settlement Costs and deducted from the Settlement Fund.

For all returned mail, the Class Administrator will perform data searches and other reasonable steps to attempt to obtain better contact information for the individuals within the Settlement Class.
Re-Mailing of Returned Settlement Notices. For all mailed postcard notices that are returned as undeliverable with a forwarding address, the Class Administrator will promptly re-mail postcard notice to such forwarding address. For all postcard notices returned without a forwarding address and for which the Class Administrator locates another address, the Class Administrator will promptly re-mail postcard notice to such other address.

  • Net Out of Settlement Amounts The Non-Defaulting Party will aggregate all Settlement Amounts into a single amount by netting out (a) all amounts that are due to the Defaulting Party for Product that has been Delivered and not yet paid for, plus, at the option of the Non-Defaulting Party, any cash, security or other Performance Assurance then available to the Non-Defaulting Party, plus any or all other amounts due to the Defaulting Party under this Agreement against (b) all Settlement Amounts that are due to the Non-Defaulting Party, plus any or all other amounts due to the Non-Defaulting Party under this Agreement, so that all such amounts will be netted out to a single liquidated amount (the “Termination Payment”) payable by the Defaulting Party. The Termination Payment, if any, is due from the Defaulting Party to the Non-Defaulting Party within two Business Days following notice.
