Rectification Notice. Subject to the above paragraph, where the Supplier fails to comply with any of its obligations under the Contract, the Board may issue a rectification notice to the Supplier setting out the manner and time-frame for rectification. Within seven (7) Business Days of receipt of that notice, the Supplier shall either: (a) comply with that rectification notice; or (b) provide a rectification plan satisfactory to the Board. If the Supplier fails to either comply with that rectification notice or provide a satisfactory rectification plan, the Board may immediately terminate the Contract. Where the Supplier has been given a prior rectification notice, the same subsequent type of non-compliance by the Supplier shall allow the Board to immediately terminate the Contract.
Rectification Notice. (1) Within five (5) business days of inspecting the Works set out in a Completion Notice Council must provide notice in writing (Rectification Notice) to the Developer that the Works set out in the Completion Notice: (a) have been Completed; or (b) have not been Completed, in which case the notice must also detail: (i) those aspects of the Works which have not been Completed; and (ii) the work Council requires the Developer to carry out in order to rectify the deficiencies in those Works. (2) If Council does not provide the Developer with a Rectification Notice in accordance with paragraph (1), the Works set out in the Completion Notice will be deemed to have been Completed. (3) Where Council serves a Rectification Notice on the Developer, the Developer must: (a) rectify the Works in accordance with that notice; or (b) serve a notice on the Council that it disputes the matters set out in the notice. (4) Where the Developer: (a) serves notice on Council in accordance with paragraph (3)(b), the dispute resolution provisions of this document apply; or (b) rectifies the Works in accordance with paragraph (3)(a), it must serve upon the Council a new Completion Notice for the Works it has rectified.

Rectification Notice. A Rectification Notice shall state:- 12.2.1 that it is a Rectification Notice; 12.2.2 the nature of the Default; 12.2.3 the action required to rectify the Default; and 12.2.4 the time within which the Default is to be remedied (which shall be such time as the Council’s Representative reasonably determines).

Rectification Notice. (1) Where the Developer or Melbourne Water reasonably believes that there has been a failure by an Owner to comply with this Agreement, Melbourne Water may issue a Rectification Notice to an Owner. (2) Except where rectification is, in the opinion of the Developer or Melbourne Water, required urgently, the Developer or Melbourne Water should consult with the Owner prior to issuing a Rectification Notice.
