Recurrence of Disability. Wage loss replacement at other than 75% of base salary level, shall apply at an aggregate amount of 10 days at 100% and 10 days at 90% once per calendar year. If within three (3) regular weeks of performing their regular duties, an employee becomes disabled from the same or related cause, only the remainder of the 130 days (26 weeks) benefit period shall apply. If within three (3) regular work weeks following their return to active work, an employee becomes disabled from an unrelated cause of illness or injury, their benefit period shall be 75% of base salary for a maximum of 130 days (26 weeks), if they have exhausted their enhanced entitlement of 10 days at 100% and 10 days at 90%. Continuous Service A period of unbroken employment with the Region of Niagara, plus any additional eligible service as a result of transfer from another participating employer including: o vacation days and holidays granted o temporary layoffs o interruptions of services as approved by the LTD carrier where applicable o authorized absences Disability When an employee has a medically determinable physical or mental impairment due to injury or disease which prevents her from performing the duties of her occupation. Earnings Base salary as previously defined, excluding overtime, premiums, or any other compensation. Existing Sick Credits Those earned sick day credits accumulated through the course of employment up to and including the effective date of ratification of the collective agreement.
