Scheduling Regulations. F-1 Tour schedules shall be posted, except in cases of emergency, two (2) weeks in advance and shall cover a six (6) week period or full-time nurses will be paid premium pay on the first tour of the new schedule. Requests for specific days off are to be submitted, in writing, at least two (2) weeks in advance of posting. F-2 Request for Tour Changes F-3 Where there is a change in the schedule from one day shift to another day shift commencing at different start times on the same day, the change will not be considered a change in schedule as defined under Article 14.12. If the nurse is advised of the change and unable to accept it due to extenuating circumstances and the Employer unilaterally changes the start time, premium pay would be applicable if the change is made with insufficient notice as per Article 14.12. F-4 A full-time nurse may request to work a permanent evening or night shift. Where such request is made the following conditions shall apply: i) The nurse will submit a written request to the Manager with a copy to the Union. ii) The Manager will provide a written response to the nurse stating her ability to honour such a request, with the provision that either the nurse or the Manager may discontinue the scheduling arrangement with four (4) weeks written notice in advance of the posted schedule. A copy of such response shall be forwarded to the Union. iii) The permanent shift arrangement applies to the individual nurse, not to the position and therefore when a nurse vacates such arrangements, said vacant line will revert back to a regular rotating line consistent with the remainder of the master rotation. iv) A nurse on permanent evening or night shift will twice a year spend two (2) weeks on day shift at a mutually agreeable time. These intervals will be at least three (3) to four (4) months apart. F-5 Scheduling - 7.5 hours (a) Full-time i) Master rotations including an individual nurses position within a master, will not be changed without first informing the nurse and the bargaining unit president and or designate. ii) A nurse will not be scheduled to work more than seven (7) consecutive days without receiving two (2) consecutive days off or premium payment shall be paid. iii) The Employer will schedule full-time every second weekend off or premium pay will apply. Scheduling Regulations. D-1 7½ Hour Tour - Nursing (a) Schedules may be agreed upon to provide for more than five (5) consecutive days of work, but not more than seven (7) consecutive days of work, without days off as long as eight (8) days off are scheduled at least each twenty-eight (28) days. In any four (4) week period, at least four (4) consecutive days off must be scheduled. (b) Tour schedules and days off will be posted at least two (2) weeks in advance and shall cover a six (6) week period. Copies of schedules will be provided to the Union upon request. Requests for specific days off are to be submitted in writing at least two (2) weeks in advance of posting. (c) Requests for change in posted time schedules must be approved by the Hospital. Such requests will be submitted in writing and co-signed by the nurse willing to exchange days off or tour of duty. (d) The Hospital will schedule each nurse at least every third weekend off. (e) A period of at least two (2) consecutive tours off shall be scheduled between a change of tours and at least 40 hours time off shall be scheduled following night duty. A shorter period of time between changes of tour may be scheduled by mutual consent. A nurse will not be required to change tours of duty more than once during a work week. (f) Not more than 2 consecutive weeks will be scheduled on evenings or nights unless otherwise mutually agreed. (g) The midnight shift is the last shift of the day and the work week shall be considered to be from Monday to Monday. (h) The scheduling regulations set out herein may be waived between December 15th and January 15th so that a nurses will be scheduled off work for not less than five (5) consecutive days at either Christmas or New Year's. i) Time off at Christmas shall include Christmas Eve day, Christmas Day and Boxing Day, and time off at New Year's shall include New Year's Eve day and New Year's Day. ii) The Hospital will post a request list by September 15th at 0900 hours. iii) Nurses will record their preferences for Christmas or New Year’s time off and any requests for specific time off by October 15th. iv) Preferred time off will be granted on the basis of seniority. Scheduling Regulations i) The Employer shall ensure each employee is scheduled to work not more than every third [3rd] weekend, except when operational requirements justify it, and then the Employer will schedule at least every other weekend off. ii) An employee will receive premium pay of time and one-half (1½) for all hours worked on a third (3rd) subsequent and consecutive weekend save and except where: A) such weekend had been worked by the employee to satisfy days off requested by the employee; or B) such weekend is worked as a result of an exchange with another employee; or C) such weekend is worked as a result of a schedule change requested by the employee; or D) the employee requests additional weekend work. iii) An employee will not be required to work more than seven (7) consecutive shifts. An employee will be paid time and one-half (1½) for their eighth (8th) subsequent and consecutive shift until a shift is scheduled off work unless as a result of a schedule change requested by the employee. iv) A mutual change of a scheduled shift shall be requested in writing by an employee and co-signed by a suitable exchange employee and submitted for approval to the Employer. The exchange of shifts between employees shall not result in overtime or other additional compensation not otherwise payable. v) Work schedules will be posted every four (4) weeks, so that eight weeks of schedule is always posted. vi) The work schedule will be posted two (2) weeks in advance of an eight (8) week period. vii) It shall be the responsibility of the employee to consult posted work schedules. The Employer will provide as much advance notice as is practicable of a change in the posted schedule. Changes to the posted work schedule shall be brought to the attention of the employee as soon as practicable. viii) Employees shall receive a minimum of twelve (12) hours off between scheduled shifts. ix) There shall be no split shifts. x) Requests for specific shifts, days off, vacation or other scheduling requests shall be made in writing at least two (2) weeks prior to the posting of the schedule. Requests with shorter notice may be considered based on operational and staffing requirements. Such requests shall not be unreasonably denied. xi) No employee will be scheduled to work both Christmas and New Year’s holidays unless requested by the employee. xii) Christmas and New Year’s scheduling will be done on a rotational basis.
