Regulation E Claims. Xxxxx Fargo will have responsibility for working claims related to inbound Regulation E adjustments from the Covered Machines in accordance with the applicable Regulation E debit network operating rules (“Network Operating Rules”). All ATM network fees associated with claims will be passed through by Xxxxx Fargo for payment by Clients. The Work under this part will consist of: a. Responding to and processing inbound Regulation E claims on behalf of Clients, which activity includes the research, decision-making and, when appropriate, payment of cardholder claims reported to Xxxxx Fargo against Clients’ Covered machines, using Clients supplied electronic journal, host and error log data and other applicable machine balancing information. Xxxxx Fargo will respond to claims within the periods provided for in the Network Operating Rules for claims response, subject to its receipt of necessary data and response to information requests from Clients, Armored Carriers and Maintenance Providers. b. Process payment of inbound Regulation E claims under $59, without research. Xxxxx Fargo will file shortage claims for claimable Losses with the Armored Carriers postmarked within five business days of servicing and will provide an electronic file to Clients listing differences on a weekly basis.

Regulation E Claims. Any claim submitted under Federal Reserve Regulation E for transactions processed prior to the Closing Date shall be settled as follows: (a) If such claim is submitted to Seller, Seller shall process the claim under the guidelines specified in “Regulation E,” and if a reimbursement to the customer is determined necessary, Seller shall directly reimburse the customer. (b) If the claim is submitted to Buyer, Buyer shall process the claim under the guidelines specified in “Regulation E,” and if a reimbursement to the customer is determined necessary, Buyer shall directly reimburse the customer and notify Seller of such reimbursement. Seller shall remit by wire transfer within twenty-four (24) hours of notice an amount equal to the reimbursement paid by Buyer to the customer. (c) Such settlement shall continue for ninety (90) calendar days following the Closing Date. All claims submitted after such 90-day period shall be returned by Seller to the originator of the claim.

  • Submitting False Claims The full text of San Francisco Administrative Code Chapter 21, Section 21.35, including the enforcement and penalty provisions, is incorporated into this Agreement.   • Submitting False Claims; Monetary Penalties The AOC shall be entitled to remedy any false claims, as defined in California Government Code section 12650 et seq., made to the AOC by the Contractor or any Subcontractor under the standards set forth in Government Code section 12650 et seq. Any Contractor or Subcontractor who submits a false claim shall be liable to the AOC for three times the amount of damages that the AOC sustains because of the false claim. A Contractor or Subcontractor who submits a false claim shall also be liable to the AOC for (a) the costs, including attorney fees, of a civil action brought to recover any of those penalties or damages, and (b) a civil penalty of up to $10,000 for each false claim.

  • FALSE CLAIMS Contractor warrants that it shall not, with respect to this Contract, make or present any claim upon or against the Government of the Virgin Islands, or any officer, department, board, commission, or other agency thereof, knowing such claim to be false, fictitious or fraudulent.
