Rejected application for SFH loan. If an application for a SFH loan is being rejected because income is too high, a statement should be included in the re- jection letter that inventory properties may be available for which they may apply. [50 FR 23904, June 7, 1985, as amended at 53 FR 27839, July 25, 1988; 58 FR 38928, July 21, 1993] This section provides guidance on the sale of all Rural Development inven- tory property, except suitable FP real property which will not be sold by sealed bid. Before a sealed bid sale, the State Director will determine and doc- ument the minimum sale price accept- able. In determining a minimum sale price, the State Director will consider the length of time the property has been in inventory, previous marketing efforts, the type property involved, and potential purchasers. Program financ- ing will be offered on sales of program and suitable property. For NP or sur- plus property, credit may be extended to facilitate the sale. When a group of properties is to be sold at one time, ad- vertising may indicate that Rural De- velopment will consider bids on an in- dividual property or a group of prop- erties and Rural Development will ac- cept the bid or bids which are in the best financial interest of the Govern- ment. Credit, however, may not exceed the market value of the property nor may the term exceed the period for which the property will serve as xxx- xxxxx security. Sealed bids will be made on Form RD 1955–46 with any ac- companying deposit in the form of cashier’s check, certified check, postal or bank money order or bank draft payable to Rural Development. For program and suitable property, the minimum deposit will be the same as outlined in § 1955.130(e)(1) of this sub- part. For NP or surplus property, the minimum deposit will be ten percent (10%). The bid will be considered deliv- ered when actually received at the Rural Development office. All bids will be date and time stamped. Advertise- ments and notices will request bidders to submit their bid in a sealed envelope marked as follows: SEALED BID OFFER lllll*lllll.’’ (*Insert ‘‘PROPERTY IDENTIFICATION NUMBER lllll).

  • Completion of Review for Certain Review Receivables Following the delivery of the list of the Review Receivables and before the delivery of the Review Report by the Asset Representations Reviewer, the Servicer may notify the Asset Representations Reviewer if a Review Receivable is paid in full by the Obligor or purchased from the Issuer in accordance with the terms of the Basic Documents. On receipt of such notice, the Asset Representations Reviewer will immediately terminate all Tests of the related Review Receivable, and the Review of such Review Receivables will be considered complete (a “Test Complete”). In this case, the related Review Report will indicate a Test Complete for such Review Receivable and the related reason.

  • Request for a Panel 1. Unless the Parties agree on a different period for consultations, a complaining Party may request in writing the establishment of a Panel if the consultation referred to in the Article 176 (Consultations) fails to resolve a matter within 60 days, after the date of receipt of the request for consultations or 50 days in case of urgent matters. 2.   • Determination to Honor Drawing Request In determining whether to honor any request for drawing under any Letter of Credit by the beneficiary thereof, Agent shall be responsible only to determine that the documents and certificates required to be delivered under such Letter of Credit have been delivered and that they comply on their face with the requirements of such Letter of Credit and that any other drawing condition appearing on the face of such Letter of Credit has been satisfied in the manner so set forth.

  • Request for Review Within sixty (60) days after receiving notice from the Plan Administrator that a claim has been denied (in part or all of the claim), then claimant (or their duly authorized representative) may file with the Plan Administrator, a written request for a review of the denial of the claim. The claimant (or his duly authorized representative) shall then have the opportunity to submit written comments, documents, records and other information relating to the claim. The Plan Administrator shall also provide the claimant, upon request and free of charge, reasonable access to, and copies of, all documents, records and other information relevant (as defined in applicable ERISA regulations) to the claimant’s claim for benefits.

  • Application to Term Loans With respect to each prepayment of Term Loans required by Section 5.2(a), the Borrower may, if applicable, designate the Types of Loans that are to be prepaid and the specific Borrowing(s) pursuant to which made; provided, that if any Lender has provided a Rejection Notice in compliance with Section 5.2(f), such prepayment shall be applied with respect to the Term Loans to be prepaid on a pro rata basis across all outstanding Types of such Term Loans in proportion to the percentage of such outstanding Term Loans to be prepaid represented by each such Class. In the absence of a Rejection Notice or a designation by the Borrower as described in the preceding sentence, the Administrative Agent shall, subject to the above, make such designation in its reasonable discretion with a view, but no obligation, to minimize breakage costs owing under Section 2.11.
