Common use of Rejection Following Promotion Clause in Contracts

Rejection Following Promotion. Any employee rejected during the probationary period following a promotional appointment shall be reinstated to the position from which he/she was promoted unless charges are filed and he/she is discharged in the manner provided in Section 21 (Rules of Appeal to Hearing Officer) for positions in the competitive services.

Rejection Following Promotion. Any employee rejected during the probationary period following a promotional appointment shall be reinstated to the position from which he/she was promoted unless charges are filed and he/she is discharged terminated in the manner provided in Section 21 (the Personnel Ordinance and the Personnel Rules of Appeal to Hearing Officer) for positions in the competitive servicesservice. However, if the employee's former position has been filled, he/she may be placed in a vacant position in the same classification from which he/she was promoted. If there are no vacant positions, he/she may be ultimately terminated from City service.
