Relationship of Parties; No Third Party Beneficiaries. Nothing in this Agreement shall be construed to alter the existing debtor-creditor relationship between the Note Parties and the Holders. This Agreement is not intended, nor shall it be construed, to create a partnership or joint venture relationship between or among any of the parties hereto. No person other than a party hereto is intended to be a beneficiary hereof and no person other than a party hereto shall be authorized to rely upon or enforce the contents of this Agreement.

(b) This Agreement is not intended to, and does not, confer upon any Person other than the Parties hereto and their respective successors and permitted assigns, any rights, benefits, or remedies hereunder.

This Amendment No. 4 is not intended, nor shall it be construed to create, a partnership or joint venture relationship between or among any of the parties hereto. No person or entity other than a party hereto is intended to be a beneficiary hereof and no person or entity other than a party hereto shall be authorized to rely upon the contents of this Amendment No. 4.
Relationship of Parties; No Third Party Beneficiaries. Nothing in this Forbearance Agreement shall be construed to alter the existing debtor-creditor relationship between the Customer and IBM Credit. Nor is this Forbearance Agreement intended to change or affect in any way the relationship between IBM Credit and each Guarantor to one other than a debtor-creditor relationship. This Forbearance Agreement is not intended, nor shall it be construed to create, a partnership or joint venture relationship between or among any of the parties hereto. No party, other than a party hereto is intended to be a beneficiary hereof, and no party other than a party hereto shall be authorized to rely upon the contents of this Forbearance Agreement.

Nor is this Agreement intended to change or affect in any way the relationship between IBM Credit and any Guarantor to one that is other than a debtor-creditor relationship. This Agreement is not intended, nor shall it be construed to create, a partnership or joint venture relationship between or among any of the parties hereto. No Person other than a party hereto is intended to be a beneficiary hereof, and no person other than a party hereto shall be authorized to rely upon the contents of this Agreement.
Relationship of Parties; No Third Party Beneficiaries. Any intention to create a joint venture or partnership relation between the Parties is hereby expressly disclaimed, and no Party shall have the right to bind the other. There are no Agreement CXT - Hollandia - Grimbergen 10 Dated December, 2004 third party beneficiaries to this Agreement.
Relationship of Parties; No Third Party Beneficiaries. The IC shall be an independent contractor in the performance of the services hereunder. No right of supervision, requirement of approval or other provision of this Agreement and no conduct of the Parties shall be construed to create a relationship of principal and agent, partners, or joint venturers between the Parties, or joint employers of the IC’s employees. Except as specifically provided herein (including, without limitation, in the indemnification provisions hereof), nothing contained in this Agreement is intended for the benefit of any third parties.
Relationship of Parties; No Third Party Beneficiaries. Both Parties agree that they are independent entities. Nothing in this Agreement shall be construed to create a partnership, joint venture, or agency relationship between the Parties. Each Party is responsible for the supervision, management and direction of its own employees, agents and contractors. Each Party is responsible for the payment of compensation to its employees, agents and contractors and for any injury to them occurring in the course of their employment for which their employer is responsible and neither Party shall be responsible for the supervision, management and direction of the employees, agents or contractors of the other Party. Aptar and the Designated Provider that executes a Schedule and provides Services thereunder shall be jointly and severally liable for the performance of such Services. This Agreement shall not confer any rights or remedies upon any person or entity other than the Parties named herein and their respective successors and permitted assigns.
