Release of Additional Approved Security. If the Contractor has given the Commonwealth additional Approved Security for payment for unfixed goods and materials, the Commonwealth must release such security to the Contractor when those goods and materials are incorporated into the Works.

Release of Additional Approved Security. If the Subcontractor has given the Contractor additional Approved Security for payment for unfixed goods and materials, the Contractor must release such security to the Subcontractor when those goods and materials are incorporated into the Subcontract Works.
Release of Additional Approved Security. If the Contractor has given the Commonwealth additional Approved Security under clause 12.8 or clause 12.9, the Commonwealth must, when the relevant goods and materials are incorporated into the Works on Site or the relevant services have been performed, release the additional Approved Security referable to such goods, materials or services. Completion Payment Claim and Notice Within 28 days (or such longer period agreed in writing by the Contract Administrator) after the issue of a Notice of Completion for the Works or a Stage, the Contractor must give the Contract Administrator: a payment claim which complies with clause 12.2 and which must include all amounts which the Contractor claims from the Commonwealth on account of the Contract Price and all other amounts payable under the Contract; and notice of any other amounts which the Contractor claims from the Commonwealth, in respect of any fact, matter or thing arising out of or in connection with the Contractor's Activities, the Works or the Contract which: in the case of the Works, occurred prior to the Date of Completion of the Works; or in the case of a Stage, occurred prior to the Date of Completion of the Stage, insofar as the fact, matter or thing relates to the Stage. The payment claim and notice required under clause 12.11 are in addition to the other notices which the Contractor must give to the Contract Administrator under the Contract in order to preserve its entitlements to make any such Claims. Without limiting the previous paragraph, the Contractor cannot include in this payment claim or notice any Claims which are barred by clause 16.5.

Final Payment Claim Within 28 days (or such longer period agreed in writing by the Contractor's Representative) after the end of the Defects Liability Period, the Subcontractor must give the Contractor's Representative: a payment claim which complies with clause 11.2 and which must include all amounts which the Subcontractor claims from the Contractor on account of the Subcontract Price and all other amounts payable under the Subcontract; and notice of any other amounts which the Subcontractor claims from the Contractor, in respect of any fact, matter or thing arising out of or in connection with the Subcontractor's Activities, the Subcontract Works or the Subcontract which: in the case of the Subcontract Works, occurred during the Defects Liability Period for the Subcontract Works; or in the case of a Section, occurred during the Defects Liability Period for the Section, insofar as the fact, matter or thing relates to the Section. The payment claim and notice required under clause 11.9 are in addition to the other notices which the Subcontractor must give to the Contractor's Representative under the Subcontract in order to preserve its entitlements to make any such claims.

  • Notification Regarding Letting/Transfer If the Allottee lets out or transfers the said Apartment, the Allottee shall immediately notify the Promoter/Association (upon formation) of the tenant’s/transferee's address and telephone number.

  • Obligation to Notify Owner of Existing Hazardous Materials The Contractor shall immediately notify the Owner and the Design Professional, both orally and in writing, of the presence and location of any physical evidence of, or information regarding the presence of Hazardous Materials at the Site of which it becomes aware. If the Contractor encounters Hazardous Materials on the Site the Contractor shall (i) immediately stop performance of Work or that portion of the Work affected by or affecting such Hazardous Materials; (ii) secure the contaminated area against intrusion; (iii) not disturb or remove the Hazardous Materials; (iv) not proceed, or allow any subcontractor or supplier to proceed, with any Work or other activities in the area affected by such Hazardous Materials until such materials have been properly remediated and until directed in writing to do so by the Owner; and, (v) take any other steps necessary to protect life and health and the surrounding environment. The Contractor shall be entitled to adjustment of the Contract Time and the Contract Sum pursuant to Section 5, Part 2 of these General Conditions in order to compensate for the impact of any required demolition, re-work, shutdown, delay, protection of work, disruption, and start-up resulting from the encountering of such Hazardous Materials on the Site for which the Contractor is not responsible.

  • RENTAL APPLICATION The Tenant acknowledges that the Landlord has relied upon the rental application, a copy of which is attached hereto, as an inducement for entering into this agreement, and the Tenant warrants to the Landlord that the facts stated in the application are true to the best of Tenant’s knowledge. If any facts stated in the rental application prove to be untrue, the Landlord shall have the right to terminate the residency immediately and to collect from the Tenant any damages resulting therefrom.

  • Sole Source as Grounds for Rejection of a Change Order If a Change Order is submitted to Contractor for the purposes of adding a Bulletin to this Contract and said Bulletin designates a Sole Source from which Contractor is required to procure goods or services necessary to perform the Work, which Sole Source has not been designated previously, Contractor shall be entitled to reject the proposed Change Order if the designated Sole Source refuses to provide to Contractor the warranties, bonds, terms or schedule required under the Contract Documents, including any warranty or terms or schedule required by Bulletins referenced in the proposed Change Order. In such event, Contractor shall give written notice to the Owner rejecting the proposed Change Order and, if possible, shall accompany said written notice with a proposal from Contractor for changes or modifications to the Bulletin so as to eliminate the Sole Source designation but to achieve goods or services equal in quality or function. The Owner may then require the Design Professional to revise the subject Bulletin so as to eliminate the designation of the Sole Source by incorporation of Contractor's proposal or otherwise. Upon revision of the Bulletin by the Design Professional and approval thereof by the Owner, the Owner shall again submit to the Contractor a proposed Change Order for the purpose of adding the revised Bulletin to this Contract. If the Owner decides to retain the Sole Source in the Change Order and Contractor cannot acquire the full contractually required warranties from the Sole Source, Contractor shall be held only to the warranty terms and schedule obtainable from the Sole Source.

  • Additional Acceptable Uses of Student Data Contractor is prohibited from using Student Data for any secondary use not described in this agreement except:

  • LEAST RESTRICTIVE ENVIRONMENT/DUAL ENROLLMENT CONTRACTOR and XXX shall follow all LEA policies and procedures that support Least Restrictive Environment (“LRE”) options and/or Dual Enrollment options for students to have access to the general curriculum and to be educated with their nondisabled peers to the maximum extent appropriate. CONTRACTOR shall ensure that LRE placement options are addressed at all IEP team meetings regarding students for whom ISAs have been or may be executed. This shall include IEP team consideration of supplementary aids and services, goals and objectives necessary for placement in the LRE and necessary to enable students to transition to less restrictive settings. When an IEP team has determined that a student should be transitioned into the public school setting, CONTRACTOR shall assist the LEA in implementing the IEP team’s recommendations activities to support the transition.

  • Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion - Lower Tier Covered Transactions (a) The prospective lower tier participant certifies, by submission of this proposal, that neither it nor its principals is presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this transaction by any federal department or agency.
