Works on Site. 7.1 The Purchaser shall provide free unobstructed access to Site, all necessary technical information and free use of power and all on-site facilities required by the Company to perform the contract. The Company shall be entitled to charge the Purchaser for any additional time or cost arising or incurred as a result of the provision of inadequate access, power or facilities. 7.2 The Company shall not be bound by any rules, conditions or requirements of the Purchaser relating to Site unless it has received a copy of the same at least 7 days before attending Site and agrees in writing to the said rules, conditions or requirements for each Contract it may have with the Purchaser. 7.3 The Purchaser agrees to pay all additional costs incurred by the Company arising out of or connected with any delay in, suspension of or disruption to, the Works which are caused directly or indirectly by acts, omissions or defaults of the Purchaser, its employees or agents, including without limiting the generality of that term, its subcontractors.
Works on Site. Without derogating from the Supplier's obligations pursuant to this Agreement, the Supplier declares and undertakes as follows with regard to any of the Works performed by the Supplier on Site (including installation of the FACILITY on Site and/or any Operation and/or any of the Warranty and/or Maintenance Works) ( the "Works on Site"): 16.1. The Supplier shall be responsible for the performance of all of the Works on Site. 16.2. The Supplier declares that the performance of the Works on Site shall be executed by a subcontractor on behalf of the Supplier who is lawfully registered in the Contractors Registrar, pursuant to the Contractor Registration Regulations for Engineering Construction Projects Law, 1969, in the correct and appropriate sector pursuant to the aforesaid law in respect of all of the building works and their financial scope (the "Supplier's Infrastructure Subcontractor"). The Supplier undertakes to deliver to the Supplier all of the appropriate approvals to support this representation. 16.3. Without derogating from the aforesaid, in the performance of the infrastructure Works at the Site, the Supplier shall employ a head works manager certified as required by the Work Safety Regulations (Construction Works), 1988 ("Safety Regulations"), who shall be present at the Site at all times in which the Supplier shall perform the Works on Site. The Supplier undertakes accordance with Clause 6(d) of the Safety Regulations the overall responsibility as primary supplier for the performance of the provisions of the Safety Regulations. The Supplier undertakes to notify ASSOCIATION of the appointment of the aforesaid head work manager as required under Clause 6(d) of the Safety Regulations. 16.4. Without derogating from the generality of the aforesaid and the below, the Supplier undertakes to fulfill all of the obligations imposed on a "prime contractor" as defined in any law, including under the Planning and Building Law, 1965, The Planning and Building Regulations (Application for a Permit, its Conditions and Fees), 1970, the Planning and Building Regulations (Overall Supervision of Construction), 1992, Work Safety Regulations, 1988, and Regulations of the Organization of Work Supervisors (Safety Officers), 1996. 16.5. For the avoidance of doubt, it is clarified that nothing in this Section regarding the responsibility of the Supplier as a "prime contractor" shall entitle the Supplier to additional compensation, of any kind whatsoever, in respect of it...
Works on Site. £ 3.1 General The works comprise the carrying out of repair and maintenance works to the existing property which include gutter repair, renewal and clearance, flat and pitched roof repair and cleaning, a part demolition of chimney stack over area of flat roof to rear of building, some minor brickwork repairs and repointing along with part external re-decorations. The works are as detailed to this schedule and the attached site location and annotated roof plan drawings. This schedule of works should be read in conjunction with those drawings. Note that the building has a commercial use functioning as both a cinema with attached community hall. It also occupies a street side location and there is pedestrian and public access along its south side. It is therefore of critical importance that contractors take all of this into account when tendering for the work and include for all necessary protective fences, notices and so forth. Preliminaries – all costs to be included here and should allow for all the implications of Parts 1 and 2 of this specification but apportioned to each of the four work elements as applicable.   • Service Locations X.X. Xxxxxx maintains various operational/service centers and locations through the United States and foreign jurisdictions. The services provided under this Agreement may be provided from one or more such locations. X.X. Xxxxxx may change the operational/service centers and locations as it deems necessary or appropriate for its business concerns.

  • Solicitations for Subcontracts, Including Procurements of Materials and Equipment In all solicitations either by competitive bidding or negotiation made by the Engineer for work to be performed under a subcontract, including procurements of materials or leases of equipment, each potential subcontractor or supplier shall be notified by the Engineer of the Engineer's obligations under this contract and the Regulations relative to nondiscrimination on the grounds of race, color, or national origin.

  • Protection of Customer Data The Supplier shall not delete or remove any proprietary notices contained within or relating to the Customer Data. The Supplier shall not store, copy, disclose, or use the Customer Data except as necessary for the performance by the Supplier of its obligations under this Call Off Contract or as otherwise Approved by the Customer. To the extent that the Customer Data is held and/or Processed by the Supplier, the Supplier shall supply that Customer Data to the Customer as requested by the Customer and in the format (if any) specified by the Customer in the Call Off Order Form and, in any event, as specified by the Customer from time to time in writing. The Supplier shall take responsibility for preserving the integrity of Customer Data and preventing the corruption or loss of Customer Data. The Supplier shall perform secure back-ups of all Customer Data and shall ensure that up-to-date back-ups are stored off-site at an Approved location in accordance with any BCDR Plan or otherwise. The Supplier shall ensure that such back-ups are available to the Customer (or to such other person as the Customer may direct) at all times upon request and are delivered to the Customer at no less than six (6) Monthly intervals (or such other intervals as may be agreed in writing between the Parties). The Supplier shall ensure that any system on which the Supplier holds any Customer Data, including back-up data, is a secure system that complies with the Security Policy and the Security Management Plan (if any). If at any time the Supplier suspects or has reason to believe that the Customer Data is corrupted, lost or sufficiently degraded in any way for any reason, then the Supplier shall notify the Customer immediately and inform the Customer of the remedial action the Supplier proposes to take. If the Customer Data is corrupted, lost or sufficiently degraded as a result of a Default so as to be unusable, the Supplier may: require the Supplier (at the Supplier's expense) to restore or procure the restoration of Customer Data to the extent and in accordance with the requirements specified in Call Off Schedule 8 (Business Continuity and Disaster Recovery) or as otherwise required by the Customer, and the Supplier shall do so as soon as practicable but not later than five (5) Working Days from the date of receipt of the Customer’s notice; and/or itself restore or procure the restoration of Customer Data, and shall be repaid by the Supplier any reasonable expenses incurred in doing so to the extent and in accordance with the requirements specified in Call Off Schedule 8 (Business Continuity and Disaster Recovery) or as otherwise required by the Customer.

  • Access to Work Locations Reasonable access to employee work locations shall be granted officers of the Association and their officially designated representatives for the purpose of processing grievances or contacting members of the Association concerning business within the scope of representation. Such officers or representatives shall not enter any work location without the consent of the City Manager. Access shall be restricted so as not to interfere with the normal operations of the department or with established safety or security requirements.
