Common use of Release of Performance Security Clause in Contracts

Release of Performance Security. The Performance Security shall remain in force and effect until expiry of 6 (six) months after the Appointed Date, and shall be released upon the Deemed Performance Security taking effect in accordance with the provisions of Clause 9.4.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry for a period of [6 (six) )] months after from the Appointed DateOperation Date (the “Performance Security Period”); provided, and however, that the Performance Security shall not be released upon if the Concessionaire is in breach of this Agreement. Upon request made by the Concessionaire for release of the Performance Security along with the particulars which establish satisfaction of the requirements specified in this Clause 9.3 and subject to the creation of Deemed Performance Security taking effect in accordance with the provisions of Clause 9.4, the Authority shall release the Performance Security forthwith.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry for a period of [6 (six) months after months] from the Appointed DateProject COD (the “Performance Security Period”); provided, and however, that the Performance Security shall not be released upon if the Concessionaire is in breach of this Agreement. Upon request made by the Concessionaire for release of the Performance Security along with the particulars which establish satisfaction of the requirements specified in this Article 9.3 and subject to the creation of Deemed Performance Security taking effect in accordance with Article 9.4, the provisions of Clause 9.4Authority shall release the Performance Security forthwith.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry of a period of 6 (six) months after from the Appointed DateCOD of Phase III, ("Performance Security Period"), and shall be released upon the Deemed provision of a Performance Security taking effect Guarantee in accordance with the provisions of Clause 9.4.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry for the entire Concession Period. Upon completion of 6 (six) months after end of the Appointed DateConcession Period and thereby, and shall be released upon request made by the Deemed Concessionaire for release of the Performance Security taking effect in accordance along with the provisions particulars which establish satisfaction of Clause 9.4the requirements laid down in the Concession Agreement, the Authority shall release the Performance Security forthwith.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry for a period of 6 180 (sixone hundred and eighty) months after days from COD of the Appointed DateProject; provided, and however, that the Performance Security shall not be released upon if the Deemed Implementation Agency is in breach of this Agreement. Upon request made by the Implementation Agency for release of the Performance Security taking effect in accordance along with the provisions particulars which establish satisfaction of the requirements specified under this Clause 9.48.3, the Authority shall release the Performance Security forthwith.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry throughout the period of 6 Concession Agreement and shall be released within 3 (sixthree) months after the Appointed Dateexpiry of Concession Period, provided, however, that the Performance Security shall not be released and shall be released upon kept alive by the Deemed Concessionaire if the Concessionaire is in breach of this Agreement. Upon request made by the Concessionaire for release of the Performance Security taking effect in accordance along with the provisions particulars which establish satisfaction of the requirements specified in this Clause 9.49.3, the Authority shall release the Performance Security forthwith.

Release of Performance Security. The Performance Security shall remain in force and effect until till the expiry of 6 (six) three months after from the Appointed Datedate of expiry of Defect Liability Period, and however the Performance Security shall not be released upon if the Deemed Developer is in breach of this Agreement. Upon request made by the Developer for release of the Performance Security taking effect in accordance along with the provisions particulars which establish satisfaction of Clause 9.4the requirements specified under this Article, the Client shall release the Performance Security forthwith.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry for a period of 6 42 (sixforty two) months after from the Appointed Date, and shall be released upon provision of the Deemed Performance Security taking effect Guarantee in accordance with the provisions of Clause 9.4.

Release of Performance Security. The Performance Security shall remain in force and effect until till the expiry of 6 (six) months after from the Appointed DateCOD of Phase I, ("Performance Security Period"), and shall be released upon the provision of a Deemed Performance Security taking effect in accordance with the provisions of Clause 9.49.4 below.

The Performance Security shall remain in force and effect until expiry for a period of 6 (six) months after from COD; provided, however, that the Appointed Date, and Performance Security shall not be released upon if the Deemed Concessionaire is in breach of this Agreement, till such time the breach is cured. Upon request made by the Concessionaire for release of the Performance Security taking effect in accordance along with the provisions particulars which establish satisfaction of the requirements specified in this Clause 9.49.3, the Authority shall release the Performance Security forthwith.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry for a period of 6 1 (sixone) months after year from COD; provided, however, that the Appointed Date, and Performance Security shall not be released upon if the Deemed Concessionaire is in breach of this Agreement, till such time the breach is cured. Upon request made by the Concessionaire for release of the Performance Security taking effect in accordance along with the provisions particulars which establish satisfaction of the requirements specified in this Clause 9.49.3, the Authority shall release the Performance Security forthwith.

Release of Performance Security. The Performance Security shall remain in force and effect until till the expiry of 6 (six) months after 30 days from the Appointed Datedate of expiry of Defect Liability Period, and however the Performance Security shall not be released upon if the Deemed Performance Security taking effect DEVELOPER is in accordance with the provisions breach of Clause 9.4this Agreement.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry for the entire period of 6 (six) months after the Appointed DateAgreement and 180 days beyond the Termination Date and subject to provisions of Clause 8.2, and shall be released upon within 200 days post expiry of the Deemed Performance Security taking effect Term in accordance with this Agreement. Provided however, that the provisions Performance Security shall not be released if any amount to be paid by the Service Provider to the Authority is due. Upon request made by the Service Provider for release of the Performance Security along with the particulars which establish satisfaction of the requirements specified under this Clause 9.4.8.3, the Authority shall release the Performance Security forthwith

Release of Performance Security. The Performance Security shall remain in force and effect until expiry for the entire Term of 6 (six) months the Contract and till six month after the Appointed Date, and Term of the contract. It shall be released upon after 180 (one eighty) days of the Deemed Performance Security taking effect expiry of the Term or Extended Term of the Contract in accordance with the provisions of Clause 9.4this Contract.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry for a period of 6 (six) months after from the Appointed DateCOD of Phase I, ("Performance Security Period"), and shall be released upon the Deemed provision of a Performance Security taking effect Guarantee in accordance with the provisions of Clause 9.4.

Release of Performance Security. 9.3.1 The Performance Security shall remain initially be in force and effect until expiry for a period of 6 3 (sixthree) months after the Appointed Date, years and shall be released upon renewed from time to time in accordance with the Deemed terms of this Agreement. The Performance Security taking effect shall be released promptly and in any case within 60 (sixty) days of provision of a Performance Guarantee in accordance with the provisions of Clause 9.4.

Release of Performance Security. The Performance Security shall remain in force and effect until expiry the end of 6 2 (sixtwo) months after years from COD of the Appointed DatePhase I of the project; provided, and however, that the Performance Security shall not be released upon if the Deemed Concessionaire is in breach of this Agreement. Upon request made by the Concessionaire for release of the Performance Security taking effect in accordance along with the provisions particulars which establish satisfaction of the requirements specified under this Clause 9.49.3, the Authority shall release the Performance Security forthwith.

Upon request made by the Concessionaire for release of the Performance Security along with the particulars which establish satisfaction of the requirements specified in this Article 9.3 and subject to the creation of Deemed Performance Security taking effect in accordance with Article 9.4, the provisions of Clause 9.4Authority shall release the Performance Security forthwith.
