Remedying of Deficiencies. If, prior to Transmission Provider’s approval and acceptance for operation and maintenance of Transmission Provider's Interconnection Facilities and Network Upgrades, any phase of the engineering, equipment procurement, or construction of Transmission Provider's Interconnection Facilities and Network Upgrades fails to meet the standards and specifications provided by Transmission Provider, including Transmission Provider’s Technical Standards, in Xxxxxxxx X-0, Applicable Laws and Regulations, Applicable Reliability Standards, or Good Utility Practice, Interconnection Customer shall be obligated to promptly remedy deficiencies, at Interconnection Customer’s expense, in that portion of Transmission Provider's Interconnection Facilities and Network Upgrades.

Such obligation by Interconnection Customer to promptly remedy deficiencies at Interconnection Customer’s expense shall apply even if a Transfer Event has occurred prior to Transmission Provider’s approval and acceptance for operation and maintenance of Transmission Provider’s Interconnection Facilities and Network Upgrades.
Remedying of Deficiencies. If, prior to Transmission Provider’s approval and acceptance for operation and maintenance of R-Line Upgrade Project, any phase of the engineering, equipment procurement, or construction of the R-Line Upgrade Project fails to meet the standards and specifications provided by Transmission Provider, including Transmission Provider’s Technical Standards, in Xxxxxxxx X-0, Applicable Laws and Regulations, Applicable Reliability Standards, or Good Utility Practice, Interconnection Customer shall be obligated to promptly remedy deficiencies, at Interconnection Customer’s expense, in that portion of the R-Line Upgrade Project.

Related to Remedying of Deficiencies

  • Correction of Deficiencies The contractor must correct promptly any work of his/her own or his/her subcontractors found to be defective or not complying with the terms of the contract.

  • Cost of remedying Defects Any repair or rectification undertaken in accordance with the provisions of Clause 17.2, including any additional testing, shall be carried out by the Contractor at its own risk and cost, to the extent that such rectification or repair is attributable to:

  • Significant deficiencies (1) The Contracting Officer will provide an initial determination to the Contractor, in writing, of any significant deficiencies. The initial determination will describe the deficiency in sufficient detail to allow the Contractor to understand the deficiency.

  • RECTIFICATION OF DEFECTS 27.1 The Purchaser shall within 14 (fourteen) days after the Contractual Occupation Date notify the Seller in writing by way of a snaglist of all or any defects in the Unit, failing which the Purchaser shall be deemed to have accepted the Unit in good order and condition. Only ONE snaglist shall be considered. The Seller shall within a reasonable time thereafter at its cost repair all such defects and the Seller undertakes to rectify all latent and/or patent defects which become apparent to the Purchaser within 3 (three) calendar months from the Contractual Occupation Date and which is the result of defective materials and/or workmanship.

  • Correction of Defects 35.1 The Engineer shall give notice to the Contractor of any Defects before the end of the Defects Liability Period, which begins at Completion and is defined in the Contract Data. The Defects Liability Period shall be extended for as long as Defects remain to be corrected.

  • Consequences of Events of Default and Corrective Action If an Event of Default occurs, the Province may, at any time, take one or more of the following actions:

  • Contractor Default Failure of the Contractor, which has neither been remedied nor waived, to perform or otherwise to comply with the terms of the Construction Contract.

  • System defects In the event you become aware of a material defect, malfunction or virus in the System or in an Electronic Service, you will immediately notify us of such defect, malfunction or virus and cease all use of such Electronic Service until you have received permission from us to resume use.
