Representations and Contact with End Users. (a) The Access Seeker will not, except as expressly provided for under clauses 10.2 or 12.3:
Representations and Contact with End Users. The Service Provider will not, except as expressly provided for under clauses 10.2 or 12.3: represent that the LFC participates in the supply of services to the Service Provider’s Resellers or End Users, other than as the owner or operator of the LFC Network and a wholesale supplier to the Service Provider; or represent that there will be a continuing relationship between the LFC and any of the Service Provider’s Resellers or End Users. The LFC will not, except as contemplated by the LFC (End User) Terms (the relevant content of which shall apply equally as regards Exempted End Users even though such End Users do not agree to be bound by the LFC (End User) Terms): represent that the LFC participates in the supply of services to the Service Provider’s Resellers or End Users, other than as a wholesale supplier to the Service Provider; or represent that there will be a continuing relationship between the LFC and any of the Service Provider’s Resellers or End Users. Neither the LFC nor the Service Provider will attribute blame for a fault, the need for maintenance of a network or the suspension of a Service to the other party if it would be misleading, unethical, deceptive or defamatory to do so. No Relationship with the LFC: No obligation or other legal relationship is created between the LFC and the Service Provider’s Resellers or End Users by this Agreement (other than, in the case of End Users, by virtue of the LFC (End User) Terms or under clause 10.2(j)). This Agreement does not confer any right, benefit or privilege on any such Reseller or End User. No Contact: The LFC will not contact any Reseller or End User in relation to any service, which incorporates a Service, and is provided to that Reseller or End User without the Service Provider’s prior consent, except: to the extent provided for in clauses 10.2(c) to (j) inclusive, 12.3 or the Operations Manual (in each case, including as regards Exempted End Users); in the case of contact with End Users who are not Exempted End Users, in order for the LFC to enforce its rights under the LFC (End User) Terms or pursuant to clause 10.2(j); or for the purpose of allowing the LFC to undertake marketing to promote the LFC, the Services provided on the LFC Network and the use of the LFC Network generally, provided that such marketing is not targeted at any particular Reseller or End User and does not promote or otherwise relate to any particular service (dependent on a Service).   • CONTACT WITH END USERS 50.1 Each Party at all times shall be the primary contact and account control for all interactions with its End Users, unless otherwise agreed to by the Parties. End Users include active subscribers as well as those for whom Service Order installations are pending.

  • Contact with Third Parties In the event that Supplier receives a request from a third party (including an individual) to access any Personal Information in Supplier’s possession, Supplier will promptly forward a copy of such request to DXC and will cooperate with DXC in responding to any such request. Upon DXC’s request, Supplier will make Personal Information in its possession available to DXC or any Third Party designated in writing by DXC and will update Personal Information in Supplier’s possession in accordance with DXC's written instructions. If any government or competent authority requests Supplier to disclose or allow access to Personal Information, Supplier shall, unless legally prohibited, immediately notify DXC of such request and shall not disclose or allow access to such Personal Information without first giving DXC an opportunity to consult with the requesting government or authority to seek to prevent such disclosure or access. Supplier will respond to any such government or enforcement authority request only after consultation with DXC and at DXC’s discretion, unless otherwise required by law. Supplier shall promptly notify DXC if any complaints are received from Third Parties about its Processing of Personal Information, and Supplier shall not make any admissions or take any action that may be prejudicial to the defense or settlement of any such complaint. Supplier shall provide DXC with such reasonable assistance as it may require in connection with resolving any such complaint.

We will provide Subscription Services to you solely by communicating during the Hours of Coverage with the individual Support Contact(s) you appoint. For Premium Support, in order to receive 24x7 coverage for Severity 1 and 2 issues, you must provide a dedicated point of contact who will be available until the issue is resolved. You may change your designated Support Contacts by notifying us in writing and giving us five business days to process the change. The Support Contacts should have “read and write” access to the necessary files, English language communication skills and relevant technical knowledge.

It is Vendor’s sole responsibility to confirm that all e-correspondence issued from xxxx-xxx.xxx, xxxxxxx.xxx, and xxxxxxxxxxxxxxxx.xxx to Vendor’s contacts are received and are not blocked by firewall or other technology security. Failure to permit receipt of correspondence from these domains and failure to keep vendor identity and contact information current at all times during the life of the contract may cause loss of TIPS Sales, accumulating TIPS fees, missed rebid opportunities, lapse of TIPS Contract(s), and unnecessary collection or legal actions against Vendor. It is no defense to any of the foregoing or any breach of this Agreement that Vendor was not receiving TIPS’ electronic communications issued by TIPS to Vendor’s listed contacts.

  • Updating Contact Information I understand and agree that I am responsible for keeping Lock Haven University records up to date with my current physical addresses, email addresses, and phone numbers by following the procedure at MyHaven Change of Address/ Phone Form. The linked procedure is incorporated herein by reference. Upon leaving Lock Haven University for any reason, it is my responsibility to provide Lock Haven University with updated contact information for purposes of continued communication regarding any amounts that remain due and owing to Lock Haven University. ENTIRE AGREEMENT This agreement supersedes all prior understandings, representations, negotiations and correspondence between the student and Lock Haven University constitutes the entire agreement between the parties with respect to the matters described, and shall not be modified or affected by any course of dealing or course of performance. This agreement may be modified by Lock Haven University if the modification is signed by me. Any modification is specifically limited to those policies and/or terms addressed in the modification. FINANCIAL AID I understand that aid described as “estimated” on my Financial Aid Award does not represent actual or guaranteed payment, but is an estimate of the aid I may receive if I meet all requirements stipulated by that aid program. I understand that my Financial Aid Award is contingent upon my continued enrollment and attendance in each class upon which my financial aid eligibility was calculated. If I drop any class before completion, I understand that my financial aid eligibility may decrease and some or all of the financial aid awarded to me may be revoked. If some or all of my financial aid is revoked because I dropped or failed to attend class, I agree to repay all revoked aid that was disbursed to my account and resulted in a credit balance that was refunded to me. I agree to allow financial aid I receive to pay any and all charges assessed to my account at Lock Haven University such as tuition, fees, campus housing and meal plans, student health insurance, parking permits, service fees, fines, bookstore charges, or any other amount, in accordance with the terms of the aid. Federal Aid: I understand that any federal Title IV financial aid that I receive, except for Federal Work Study wages, will first be applied to any outstanding balance on my account for tuition, fees, room and board. Title IV financial aid includes aid from the Pell Grant, Supplemental Educational Opportunity Grant (SEOG), Direct Loan, PLUS Loan, Xxxxxxx Loan, and TEACH Grant programs. I authorize Lock Haven University to apply my Title IV financial aid to other charges assessed to my student account such as student health insurance, parking permits, bookstore charges, service fees and fines, and any other education related charges. I may withdraw it at any time by notifying the Financial Aid Office in writing. Prizes, Awards, Scholarships, Grants: I understand that all prizes, awards, scholarships and grants awarded to me by Lock Haven University will be credited to my student account and applied toward any outstanding balance. I further understand that my receipt of a prize, award, scholarship or grant is considered a financial resource according to federal Title IV financial aid regulations, and may therefore reduce my eligibility for other federal and/or state financial aid (i.e., loans, grants, Federal Work Study) which, if already disbursed to my student account, may need to be reversed and returned to the aid source.

  • Business Contact Information Each party consents to the other party using its Business Contact Information for contract management, payment processing, service offering, and business development purposes related to the Agreement and such other purposes as set out in the using party’s global data privacy policy (copies of which shall be made available upon request). For such purposes, and notwithstanding anything else set forth in the Agreement with respect to Client Personal Information in general, each party shall be considered a data controller with respect to the other party’s Business Contact Information and shall be entitled to transfer such information to any country where such party’s global organization operates.
