Common use of Required Court Appearance Clause in Contracts

Required Court Appearance. 9.12.1 One (1) day of absence per year, with pay, will be allowed for an employee to appear in court if subpoenaed as a witness, as a litigant, or to respond to an official order from another governmental jurisdiction for reasons not brought about through the connivance or misconduct of the employee. An exception to this paid absence limit occurs if the employee is acting in the capacity of District witness and has been requested by the District or District’s legal counsel as further described in Section 9.12.2 as follows: 9.12.2 Where an employee is required to appear in court on behalf of the interests of the District as a result of activities directly relating to his/her scope of employment (example: Police Officer testifying as a witness relative to damage to District property) the employee shall be compensated as follows: a) If such required court appearance occurs on or during the employee's regular work day, the appearance will be considered regular duty and the employee will be compensated as if he/she had been regularly on the job during the hours of the appearance. b) If such required court appearance occurs on the employee's day off, the required time of appearance will be considered as overtime for compensation purposes, subject to conditions regulating overtime as stated elsewhere in this Agreement (see Article 8.2.1, Designation of Overtime). A minimum of two (2) hours overtime shall be paid.
