Reservation of Rights of Ownership. Subject to Articles 4 and 5 and Section 6.1 of this Agreement: (a) the Property Owner reserves all of its rights as owner of the Open Lands, including the right to occupy and use the Open Lands in any way that is not expressly restricted or prohibited by this Agreement and GBLT acknowledges and agrees with such reservation; (b) subject to the rights of access granted herein to GBLT, GBLT acknowledges and agrees that throughout the Term: (i) the Open Lands shall remain private property owned by and under the exclusive control of the Property Owner; (ii) the Property Owner shall have the sole and exclusive right to limit access to the Open Lands to Authorized Persons, provided that in granting such access the Property Owner uses all reasonable efforts, having regard to its resources, to ensure compliance with the Restrictions; (iii) the Property Owner shall not be restricted from conducting or engaging in, or permitting Authorized Persons from conducting or engaging in, any activity on the Open Lands that is not expressly restricted or prohibited by the Restrictions; and (iv) the Permitted Activities are not restricted or prohibited by the Restrictions.
