Resident Responsibilities. In providing services and in participating in the Program, the Resident agrees to: 1. Comply and adhere to the policies, practices, rules, bylaws, and the regulations (hereinafter the “Policies”) of the Program, of the Graduate Medical Education Committee of the University (hereinafter “GMEC”) and of the policies of the University and of all facilities to which Resident rotates. 2. Comply and adhere to all applicable state, federal, and local laws, as well as the standards required to maintain accreditation by the Joint Commission (“TJC”), the ACGME, the Residency Review Committee (hereinafter “RRC”), and any other relevant accrediting, certifying or licensing organizations. Comply with the requirements of Ohio Ethics law that apply to employees of the University, including but not limited to Sections 102.03, 102.04 and 2921.42 of the Revised Code. 3. Participate fully in the educational and scholarly activities of the Program, including, but not limited to, the performance of scholarly and research activities as assigned by the Program Director or as necessary for the completion of applicable graduation requirements), attend all required educational conferences, assume responsibility for teaching and supervising other Residents and students, and participate in assigned Hospital and Medical (and Dental) Staff committee activities. 4. Fulfill the educational requirements of the Program. 5. Provide safe, effective and compassionate patient care and present at all times a courteous and respectful attitude toward all patients, colleagues, employees, and visitors of the Hospitals and rotation sites to which the Resident is assigned. 6. Provide clinical services commensurate with Resident’s level of training under appropriate supervision as approved by the Program in circumstances and at locations covered by the University’s professional liability insurance policies maintained on behalf of the Resident. 7. Fully cooperate with the Program and the University in coordinating and completing RRC and ACGME accreditation submissions and activities, including the legible and timely completion of patient medical/dental records, charts, reports, time cards, statistical operative and procedure logs, faculty and Program evaluations, or other documentation required by the RRC, ACGME, Hospitals, Department, or Program. 8. Fully cooperate with all Hospital and Department surveys, reviews, quality assurance and credentialing activities Apply cost-containment measures in the provision of patient care consistent with the policies of the Hospitals, Department or Program. 9. Meet Hospitals’ and State standards for immunizations at all times. 10. Acquire prior to the first three (3) months of residency training, and maintain during this Agreement, Basic Life Support certification. (The cost of Basic Life Support training will be borne by the University).

Resident Responsibilities. In providing services 4.1. Resident shall have such duties and in participating in responsibilities as assigned to him or her by the Program, Program Director through the Resident agrees to: 1. Comply Designated Institutional Official (DIO) and adhere to the policies, practices, rules, bylaws, and the regulations (hereinafter the “Policies”) of the Program, of the Graduate Medical Education Committee (GMEC) in accordance with the standards required to maintain accreditation by the American College of Graduate Medical Education (ACGME), and/or the Council on Podiatric Medical Education (CPME). Resident agrees to apply his/her best efforts, at a satisfactory level of competence as determined by the Program Director, to attain the educational objectives of the University (hereinafter “GMEC”) and of the policies of the University and of all facilities physician training program to which Resident rotates. 2is duly appointed. Comply Therefore, among other things, Resident agrees to: • participate fully in the educational activities of the Program, and adhere as required, assume responsibility for teaching and supervising other residents; • comply with all the rules, regulations, policies and procedures of CMU Health; • comply with all bylaws, rules, policies, practices, and procedures of affiliated hospitals and their medical staffs, including all sites and/or institutions to which Resident may rotate as part of the educational program; • obey all applicable state, federal, federal and local laws, as well as the standards required to maintain accreditation by the Joint Commission Commission, Healthcare Facilities Accreditation Program (“TJC”HFAP), the ACGME, the Residency Review Committee (hereinafter “RRC”)CPME, and any other relevant accrediting, certifying or licensing organizations. Comply with the requirements of Ohio Ethics law that apply to employees of the University, including but not limited to Sections 102.03, 102.04 and 2921.42 of the Revised Code. 3. Participate fully in the educational and scholarly activities of the Program, including, but not limited to, the performance of scholarly and research activities as assigned by the Program Director or as necessary for the completion of applicable graduation requirements), attend all required educational conferences, assume responsibility for teaching and supervising other Residents and students, and ; • participate in assigned Hospital and Medical (and Dental) Staff committee activities. 4. Fulfill the educational requirements of the Program. 5. Provide clinical services commensurate with Resident’s level of training under appropriate supervision competence; • participate in hospital committees and councils, especially those that relate to patient care review activities, as approved by appropriate; • develop and follow a personal program of self-study and professional growth with guidance from the faculty and Program in circumstances Director; • cooperate and at locations covered by the University’s professional liability insurance policies maintained on behalf of the Resident. 7. Fully cooperate assist with the Program and the University in coordinating and completing RRC Resident Review Committee (“RRC”) and ACGME and/or CPME accreditation submissions and activities, activities (including the legible and timely completion of but not limited to completing patient medical/dental medical records, charts, reports, time cards, statistical operative and procedure logs, faculty and Program evaluations, and/or other required documentation); • conduct himself/herself in a professional manner; • provide the Program Director with written notification of any change in status such as licensure, visa status, and/or fitness for duty; • meet clinical, academic, scholarly and scientific requirements for training; and • always seek and utilize appropriate supervision. 4.2. Resident acknowledges and agrees that CMU Partners may from time to time be required to submit reports or other information to third parties, such as an accreditation body, regarding things such as Resident’s qualifications and competency, the quality of care rendered by Resident to any given patient, and the ethical/unethical character of Resident. Resident consents to CMU Partners providing information to such third parties and further agrees, if requested, to sign such documentation as is required by the RRCCMU Partners for this purpose, ACGME, Hospitals, Department, or Programincluding but not limited to releases and consents required for CMU Partners to gain access to such information from a third party. 8. Fully cooperate with all Hospital and Department surveys, reviews, quality assurance and credentialing activities Apply cost-containment measures in the provision of patient care consistent with the policies of the Hospitals, Department or Program. 9. Meet Hospitals’ and State standards for immunizations at all times. 10. Fully cooperate with the Program and the University in coordinating and completing RRC and ACGME accreditation submissions and activities, including the legible and timely completion of patient medical/dental records, charts, reports, time cards, statistical operative and procedure logs, faculty and Program evaluations, or other documentation required by the RRC, ACGME, Hospitals, Department, or Participating Sites and Program. 89. Fully cooperate with all Hospital Participating Sites and Department University surveys, reviews, quality assurance and credentialing activities activities. Meet HospitalsParticipating Sites’ and State state standards for immunizations at all times. 1011. Fully cooperate with University personnel, agents or officials, including but not limited to attorneys, compliance officers, investigators, committees or departments of the University in any claim or situation that may arise that results in an investigation, legal matter or issue that the University determines requires Resident’s cooperation. This provision will survive expiration or termination of this Agreement. 14. Provide to the GMEC, and authorize the GMEC to disseminate to all proper parties, including Participating Sites, any and all information required by law or by any accreditation organization. 15. Return all the University’s and Participating Sites’ property including, but not limited to, books, equipment, paper, uniforms, identification, and keys; complete all necessary records; and, settle all professional and financial obligations upon the expiration or termination of this Agreement.
