RESPONSIBILITIES OF THE DESIGNER. 4.1 The Designer shall perform the Designer Services in accordance with the requirements of this Contract, and in accordance with the Standard of Care. The Designer shall exercise due care and diligence in the rendition of all services under this Contract in accordance with such professional standards and shall exercise the Standard of Care to provide the services required under this Contract in conformity with all Applicable Laws.
RESPONSIBILITIES OF THE DESIGNER. 4.1. In providing construction management services described in this Agreement, the CM shall maintain a working relationship with the Designer and the CM shall cooperate with and assist the Designer in the performance of the Designer's duties relating to the School Projects. The written Agreement between the Owner and the Designer (see Appendix A and especially Articles 3.0.1 and 3.0.2 therein) likewise requires the Designer to cooperate with and assist the CM. The Designer is solely responsible for the design of each School Project and shall perform in accordance with its agreement with the Owner. Nothing in this Agreement shall be construed to mean that the CM is responsible for the design of any School Project or that the CM assumes any of the contractual or customary duties of the Designer or any other persons or parties not specified by this Agreement. The CM and the Designer shall each be provided with a copy of the other’s contract with the Owner and the CM shall familiarize itself with the provisions of the Designer's contract to enable the CM to fulfill its obligation to cooperate with and assist the Designer.
